JAKARTA (MKRI) — The legislative candidate of the National Democratic Party (NasDem) Tiara Putri Julinar submitted a petition on 2024 General Election Results Dispute (PHPU) to the Court for the filling of the West Java DPR electoral district II. Tiara is candidate number 3 who argues that there is a vote dispute among fellow NasDem candidates.

“There is a difference in vote acquisition according to the calculation of the Petitioner and the Respondent [KPU], the Petitioner's vote should be added 28 votes, while Mr. Rajiv's vote (candidate number 5) should be reduced by 1,898 votes,” said the Petitioner's legal counsel Yupen Hadi in the Plenary Session Room of Building 1 of the Court, Central Jakarta on Tuesday, April 30, 2024.

Yupen said that the vote inflation was due to a calculation error made by the KPU in the recapitulation stage. The West Bandung Regency KPU implemented the decision of the West Bandung Regency Elections Supervisory Body (Bawaslu), it was proven that Rajiv's votes were inflated from 17,402 votes to 16,191 votes.

However, the Respondent did not heed and implement Bawaslu's recommendation to carry out recounts and corrections at all polling stations for various reasons. Until based on KPU Decree Number 360 of 2023, Rajiv was determined to be the candidate who received the most votes within the Nasdem Party and received a DPR RI seat from the West Java II in the 2024 Election.

Petitioner requests the Court cancel the KPU Decree Number 360 of 2024 concerning the Determination of election results for Members of the DPR, Regional Representatives Council (DPD), Provincial Regional Legislative Council (DPRD), and Regency/City DPRD nationally in the 2024 Election which was announced nationally on Wednesday, March 20, 2024 at 22:19 WIB throughout the West Java II Election District for the filling of candidates for DPR RI. She also requested that the Court determine the correct vote acquisition results according to the Petitioner for the filling of the membership of the DPR RI West Java Electoral District II of the NasDem. According to her, Tiara Putri Julinar received 56,182 votes while Rajiv received 56,120 votes, so she should have won 62 votes.

Case Number 109-02-05-12/PHPU.DPR-DPRD-XXII/2024 was presided in by Chief Justice Suhartoyo (Chair of Panel 1) along with Constitutional Justices Daniel Yusmic and M. Guntur Hamzah.
