JAKARTA - (MKRI) - Lydia Fransisca, a Great Movement Party (Gerindra) legislative candidate (caleg), filed a Dispute over the General Election Results (PHPU) 2024 with the Constitutional Court (MK) to fill Bekasi Regency DPRD seats in Electoral District (dapil) of Bekasi 2. she alleged a shift or change in votes among fellow Gerindra Party candidates between her and Iwan Setiawan.
"The issue raised by the petitioner is the dispute over vote acquisition in her petition for the vote count of the Bekasi Regency DPRD members in the Gerindra Party's Bekasi 2 electoral district between Dr. Lydia Fransisca SH M.Kn and Iwan Setiawan S.Sos," her legal counsel, Rizal Khoirur Roziqin, said in the Preliminary Courtroom of MK Main Building, Central Jakarta on Tuesday, April 30, 2024
Rizal explained that the Gerindra vote acquisition and Bekasi Regency Regional Legislative Council (DPRD) candidates' votes changed during the recapitulation of West Cikarang Subdistrict vote count results. Iwan Setiawan gained 1,522 votes across 317 polling stations in nine villages in West Cikarang Subdistrict, according to the petitioner. The vote count changed, impactingthe petitioner.
The petitioner asks the Court to annul the General Elections Commission (KPU) Decision No. 360 of 2024 about the certification of the 2024 presidential and legislative election results, announced nationally on Wednesday, March 20, 2024, at 10:19 PM WIB, for Bekasi 2 electoral district seats. The petitioner also asks the Court to order the KPU to recount the ballots (PSSU) across the 317 polling stations in the nine villages of West Cikarang Subdistrict, Bekasi Regency, West Java Province, or to determine the correct vote acquisition for the Gerindra Party's Bekasi 2 electoral district DPRD membership. According to the petitioner, Iwan Setiawan received 8,989 votes and Lydia Fransisca 9,333.
Case No. 59-02-02-12/PHPU.DPR-DPRD-XXII/2024 was heard in Panel 1 led by Chief Justice Suhartoyo with Constitutional Judge Daniel Yusmic P. Foekh and M. Guntur Hamzah.
