Demokrat Alleges Perindo’s Votes Inflated in N. Maluku 4

JAKARTA (MKRI) — The Democratic Party (Demokrat) filed a petition for the election results dispute (PHPU) of 2024 for the House of Representatives (DPR), Provincial Legislative Counci (DPRD), and Regency/City Legislative Counci (DPRD) in electorial district 4 of provincial DPRD of North Maluku. The Democratic Party argues that the Respondent (General Elections Commission [KPU]) added 15 votes for the United Indonesia Party (Perindo).

"The Petitioner believes that the excess of 15 votes is invalid due to an error in the summation or input of votes by the Respondent," said legal counsel Cepi Hendrayani in panel 2, on Tuesday (30/04/2024).

Cepi explains that the addition of Perindo Party votes by the Respondent was due to a summation error in the Model D. Results of South East Gane Subdistrict, South Halmahera Regency, North Maluku Province. According to the C. Results data owned by the Petitioner, the votes belonging to the Perindo Party should have been 397 votes. However, it was different from the D. Results data owned by the Respondent, which was 412 votes. Thus, there is an addition of 15 votes for Perindo Party.

The additional votes were for Perindo Party Legislative Candidate Number 1 whose total votes were 384 according to the Petitioner's C-Results data. However, it is different from the Respondent's D-Results data of 398 votes which made Perindo Party to be written as 412 votes.

The Petitioner has been proven to file objections or records of special events that are tiered since the occurrence of vote inflation or additional votes at the South Halmahera Regency KPU level at the North Maluku Provincial KPU level. However, the Chairman of the KPU as the head of the plenary meeting of the recapitulation of the vote count results at the North Maluku Provincial KPU level ignored the recommendation of the North Maluku Provincial Bawaslu to conduct a review of the Chairman of the KPU's Decree which had approved the recapitulation of the vote count results for North Maluku District 4.

The Petitioner requests that the Court cancel KPU Decree No. 360 of 2024 concerning the Determination of General Election Results for Members of the DPR, DPD, Provincial DPRD, and Regency/City DPRD nationally in the 2024 Election which was announced on Wednesday, March 20, 2024 at 22:19 WIB along the Perindo Party's vote acquisition in the electoral district 4 North Maluku for the filling of candidates for members of the Provincial DPRD; TPS 1 Ranga Ranga Village, South East Gane Subdistrict, South Halmahera Regency, North Maluku Province; D Results of the Provincial DPRD Subdistrict, South East Gane Subdistrict; D Results of South Halmahera Regency DPRD North Maluku Province; and D Results of North Maluku Province DPRD North Maluku Province.

Also, The Petitioner requests that the Court certify the correct vote results for the Petitioner to fill in the candidate for the North Maluku Provincial DPRD Electoral District 4. According to the Petitioner, the Democratic Party received 7,047 votes, while the Perindo Party received 7,044 votes.

Case No. 171-01-14-32/PHPU.DPR-DPRD-XXII/2024 was heard in Panel 2 presided over by Deputy Chief Justice Saldi Isra (panel chair) and Constitutional Justices Ridwan Mansyur and Arsul Sani.
