JAKARTA (MKRI) — The Constitutional Court (MK) held the preliminary hearing of the 2024 DPR/DPRD (House of Representatives/Regional Legislative Council) election results on Tuesday, April 30, 2024. The hearing for case No. 18-02-21-01/PHPU.DPR-DPRD-XXII/2024, filed by the Democratic Party, was presided over by Constitutional Justices Arief Hidayat (panel chair), Anwar Usman, and Enny Nurbaningsih.

The Petitioner challenges the DPR/DPRD election results for the electoral district of Aceh 2 in Aceh Province in relation to the General Elections Commission (KPU) Decree No. 360 of 2024 on the certification of the 2024 nationwide presidential and legislative election results (Provincial/Regency/City DPR, DPD, DPRD) announced on March 20, 2024 at 22:19 WIB.

“There are different versions of vote acquisition according to the Respondent (KPU) and the Petitioner for the electoral district of Aceh 2 in East Aceh Regency before and after correction. Before correction, Democratic Party candidate Ridhwan Arifflah Rusli Bintang had 31,468 votes, but after correction it became 5,155 votes for East Aceh 2,” said the Petitioner’s legal counsel Reinhard Romulo Silaban.

The change in votes, the Petitioner alleges, was legally flawed since the it was discovered that the day and date of correction are not shown in the D-result forms. Upon investigation, the Respondent has allegedly purged the Petitioner’s votes for candidate number 2. As many as 30,623 votes for the Democratic Party candidate have allegedly been transferred to the Prosperous Justice Party (PKS), who allegedly colluded with the Respondent.

The Petitioner raised an objection on the vote purge through a tiered complaint on special incident. It had legally filed the objection to the East Aceh Regency Independent Election Commission (KIP), Aceh Provincial KIP, East Aceh Regency Bawaslu (Elections Supervisory Body), Aceh Provincial Bawaslu, Central KPU, and Central Bawaslu.

Therefore, the Petitioner appeals to the Court to annul the KPU Decree No. 360 of 2024 relating to the vote acquisition of DPR members for the National Democratic Party (NasDem) in the second electoral district of East Aceh Regency, to return the Petitioner’s missing votes in East Aceh Regency, and to certify its version of the accurate vote acquisition.
