JAKARTA (MKRI) — Francine Widjojo, acting as the legal counsel of the Indonesian Solidarity Party (PSI), presented her statement for the 2024 legislative election results dispute (PHPU Legislative) petition for the House of Representatives (DPR), the Regional Legislative Council (DPRD Provinsi), and District/City Legislative Council. The hearing for the Legislative Election Results Dispute Number 228-01-15-15/PHPU.DPR-DPRD-XXII/2024 was conducted by Panel 2 chaired by Deputy Chief Justice Saldi Isra, along with Constitutional Justices Ridwan Mansyur and Arsul Sani on Monday, April 29, 2024.
PSI (Petitioner) in their petition requests the Court to annul General Election Commission (KPU) decision Number 360 of 2024 regarding the Certification of Election Results of the Presidential and Vice Presidential Election, Members of the House of Representatives, the Regional Representatives Council, the Regional Legislative Council, and District/City Legislative Councils for the filling of legislative candidate of the Malang City 5 Electoral District Legislative Council that announced on Wednesday, March 20, 2024, at 22:19 WIB.
Based on the comparison of vote counts, the Respondent and Petitioner reported counts of 5,545 and 5,593 votes respectively, resulting in a discrepancy of 51 votes. The Petitioner argues that this difference stems from a miscount by the Lowokwaru Sub-district Election Committee (PPK) during the recapitulation process, potentially impacting the Petitioner's vote tally across several polling stations (TPS). To bolster their claim, the Petitioner has documented numerous errors, including an addition of 60 votes for the Indonesian Democratic Party of Struggle (PDIP) and 1 vote for the Prosperous Justice Party (PKS) in the Dinoyo Sub-district.
" In Jatimulyo Sub-district, there was an addition of 10 votes for PKS and 20 votes for PDIP, while in Tunjungsekar Sub-district, there was an addition of 250 votes for PKS and 189 votes for PDIP. Based on these descriptions, the Petitioner requests the Constitutional Court to render a decision by establishing the correct vote count according to the Petitioner for the filling of the Malang City Legislative Council membership in the Malang City 5 electoral district, namely PKS with 16,581 votes; PDIP with 16,517 votes; the National Democratic Party (NasDem) with 5,059 votes; and PSI with 5,593 votes." stated Duta Prayoga, who is also part of the legal team representing PSI.
