PPP Claims Votes in W. Sumatra 1 Went to Garuda

JAKARTA (MKRI) — The United Development Party (PPP) filed a petition on the 2024 legislative election of the DPR (House of Representatives), Provincial and Regency/City DPRD (Regional Legislative Council) of West Sumatera Province to the Constitutional Court (MK). It alleges that its votes have been transferred to the Change Indonesia Guardian Party (Garuda) for the DPR election in the electoral district (dapil) of West Sumatera I.

“We submit this petition not to shift the seat,my Honour,  but for our legal politics within the parliamentary threshold," said the Petitioner's legal counsel, Dega Kautsar Pradana, in the Preliminary Courtroom of Main of the Constitutional Court, Central Jakarta, on Monday (29/04/2024).

The Petitioner claimed that the Indonesia Guard Of Change Party (Garuda) illegally transferred votes from them to elect DPR members in West Sumatra In 35 electoral districts across 19 provinces, the General Elections Commission (KPU) count and the Petitioner's version differ in the vote acquisition of the United Development Party (PPP) and Garuda. This vote transfer occurred in West Sumatra 1.

The Petitioner claimed that a KPU counting error transferred 5,611 PPP votes to the Garuda Party, illegally increasing its vote acquisition from 90 to 5,701. Thus, PPP's 46,906 votes were unlawfully reduced to 41,295 votes.

PPP invalid votes were transferred to Garuda until the national recapitulation, which was contained in KPU Decree No. 360 of 2024 .Petitioner filed an objection with the provinces Elections Supervisory Body (Bawaslu) for the electoral district. According to KPU Decree No. 360 of 2024, PPP fell short of the parliamentary threshold of 4 percent by 193,088 votes, or 0.13 percent. KPU Certified that PPP received 5,878,777 votes, or 3.8% nationally.

In its Petitum, The Petitioner asks the Court to annul KPU Decree No. 360 of 2024 on Certification of General Election Results for President and Vice President, Members of the House of Representatives (DPR), Regional Representatives Council (DPD), Provincial and Regency/City Legislative Councils (DPRD) in the 2024 General Election. This Decree was announced on March 20, 2024 and relates to the results of the general election of members of the House of Representatives in Electoral District of West Sumatera 1, West Sumatera Province (PT 4 Percent Conversion). The Petitioner also asks the Court to certify the correct vote acquisition for DPR RI members in the Electoral District of  West Sumatra I for 2024 (conversion to 4 percent PT), with PPP receiving 46,906 votes and Garuda 90 votes.

Case No. 119-01-17-03/PHPU.DPR-DPRD-XXII/2024  was heard by the first Panel, led—Chief Justice Suhartoyo with Constitutional Justices Daniel Yusmic P. Foekh and M. Guntur Hamzah.
