JAKARTA (MKRI) — The Constitutional Court (MK) held a preliminary hearing for the legislative election results disputes (PHPU) filed by the National Awakening Party (PKB) for Central Papua Province. The hearing of case No.  07-01-01-36/PHPU.DPR-DPRD-XXII/2024 was presided by Constitutional Justices Arief Hidayat (panel chair), Anwar Usman, and Enny Nurbaningsih, at panel 3 courtroom, on Monday, April 29, 2024. The PKB (Petitioner) filed a petition to cancel the General Election Commission (KPU) Decree No. 360 of 2024.

Legal counsel Subani, states that the vote acquisition of DPRD candidates of electoral district 8 in Central Papua, which was announced by the Respondent, is not correct. “The margin of the vote acquisition was caused by a reduction of 1,496 votes in the Petitioner's at  the Tinggi subdistrict. The vote reduction occurred because the D-Results input did not correspond with the Form C-Copy Results. This happened because of the manipulation from all candidates of all parties," he said.

Furthermore, related to the Provincial DPRD election of electoral district 2 in Dieyai Regency, he states that Form D-Results were in accordance with the results of the plenary meeting that had been approved by the district election committee (PPD). In the KPU announcement, there was a margin of 298 votes. In Mimika electoral district 2, there were additional votes from political parties and candidates who were allegedly taken from the remaining unvoted ballots totaling 3,475 votes.

"In addition to the additional votes from unvoted ballots, there were also additional votes from other political parties and candidates at polling station 31 Kebun Sirih Village, Wiweka Regency of Papua totaling 724 votes," he continued.

Thus, the Petitioner requests that the Court grant his petition in its entirety, and to annul the KPU decree related to the DPRD election of Central Papua Province.
