JAKARTA (MKRI) — The Constitutional Court (MK) held the preliminary hearings for the 2024 Regional Legislative Council (DPRD) of electoral district (dapil) 4 of Mimika Regency on Monday, April 29, 2024. The case No. 137-02-01-36/PHPU.DPR-DPRD-XXII/2024 was filed by Muhammad Asri, a DPRD candidate from the National Awakening Party (PKB).
In the preliminary hearing presided over by the Constitutional Justices Arief Hidayat (panel chair), Anwar Usman and Enny Nurbaningsih, the Petitioner argues differences in votes between the election results certified by the Respondent (General Election Commission (KPU) and the correct votes results according to the Petitioner.
According to the Petitioner’s legal counsel, Subani, the Petitioner's vote should have 2,613 votes, but the result certified by the Respondent was only 1,247 votes.
"According to the Petitioner, the votes should be 2,613. While the Respondent certified only 1,247 votes," he said.
The Petitioner alleged the vote difference was caused by the addition or excess votes for PKB in Waniai District by 6 votes; vote inflation for Benyamin Sarira, PKB candidate number 2 in Waniai District by 494 votes; vote inflation for Windi Kalbi, PKB candidate number 3 in Waniai District by 41 votes; and vote inflation for Emus Kogoya, PKB candidate number 4 in Waniai District by 87 votes.
Therefore, through his legal counsel, the Petitioner requests the Court to grant his petition in its entirety, cancel the KPU Decree No. 360 of 2024, and certify the correct vote acquisition results according to the Petitioner. (*)
