JAKARTA (MKRI) — Indra Bustomi, candidate number 1 from the National Awakening Party (PKB) for the Regional Legislative Council (DPRD) for Bangkalan 4 electoral district (dapil) filed a legislative election results dispute petition to the Constitutional Court (MK). The hearing was presided over by the panel 2—Deputy Chief Justice Saldi Isra (panel chair) and Constitutional Justices Ridwan Mansyur and Arsul Sani—in the panel 2 courtroom on Monday, April 29, 2024.

The Petitioner, Indra Bustomi in Case No.  49-02-01-15/PHPU.DPR-DPRD-XXII/2024 appealed to the Court to annul the General Elections Commision (KPU) Decree No.360 of 2024 that announced on Wednesday, March 20, 2024 at 22:19 WIB. Based on this decision, the Petitioner found that there was a margin with Candidate No 9 Fuad Hasyim from the same party.

The number of votes obtained based on the Petitioner’s calculation was 11,012, while according to the Respondent it was 9,455 votes, so there was a margin of 1,557 votes. Meanwhile, Fuad Hasyim obtained 10,691 votes and according to the Respondent, 12,483 votes, thus creating a margin of 1,792 votes.

The petitioner through Eko Sasmito as a legal counsel mentioned that the causes of margin in vote acquisition. Some of the vote recapitulation at the sub district election committee (PPK) Modung dan Blega were not under procedures that according to KPU RI Regulation No 5 of 2024 concerning the recapitulation of vote count results and the determination of general election results. The PKB vote in Modung Sub-district was 10,599 votes, with details of the Petitioner getting 15 votes, while Fuad Hasyim received 10,532 votes.

The vote for the PKB in Subdistrict Blega was 9,186, with the petitioner obtaining 9,040 votes,  while Fuad Hasyim obtained 104 votes. According to the Petitioner, there were errors and inaccuracies in the recapitulation process, resulting in changes in the vote acquisition in the form of a reduction in the Petitioner's vote,” Eko explained before Justices.

Therefore, the Petitioner appealed to the Court to repeal the KPU’s Decree No. 360 of 2024 that announced on Wednesday, March 20, 2024 at 22:19 WIB for the electoral district (dapil) Bangkalan 4  to fill Bangkalan Regency DPRD member from the National Awakening Party; establishing the results of the Petitioner's votes for filling the membership of the Regency DPRD in Dapil Bangkalan 4, namely the Petitioner 11. 012 votes and Fuad Hasyim obtained 10,691 votes.
