JAKARTA (MKRI) — The Constitutional Court (MK) held a preliminary hearing for the 2024 legislative election of the DPR (House of Representatives), Provincial and Regency/City DPRD (Regional Legislative Council) on Monday, April 29, 2024. The petition was filed by the Indonesian Democratic Party of Struggle (PDI-P).

Through petition No. 04-01-03-36/PHPU.DPR-DPRD-XXII/2024, PDI-P challenges the KPU decree No. 360 of 2024 on the national certification of the presidential and legislative election announced on Wednesday, March 20, 2024 at 22:19 WIB.

Missing Votes in Central Papua Electoral District 3 and 5

In the preliminary hearing led by Constitutional Justices Arief Hidayat, M. Guntur Hamzah, and Enny Nurbaningsih, the Petitioner found irregularities and differences between District/Subdistrict D-Results and Regency D-Results up to the level of Provincial D-Results and D-Results National Results. Therefore, the Petitioner has submitted Form D. Objection to the recapitulation of the vote count at the Mimika district/city level. However, the Respondent did not heed the objections raised by the Petitioner regarding the difference in results.

The Petitioner also questioned the reduction of votes obtained by the Petitioner in the election results using the Noken system which had been determined by the KPU. The Petitioner explained that the margin lost was 2,776 votes which should have been obtained by the PDI-P in Central Papua Electoral District 5.

The Petitioner also questioned the alleged missing votes in Central Papua Electoral District 3. Based on the results of the KPU's decision, petitioner requested the Constitutional Court to annul the KPU's decision and determine the correct vote results in accordance with the facts on the ground.
