JAKARTA (MKRI) — The Indonesian Democratic Party of Struggle (PDI-P) filed a petition on the 2024 legislative election of the DPR (House of Representatives), Provincial and Regency/City DPRD (Regional Legislative Council) of West Sumatera Province to the Constitutional Court (MK). It wishes to correct the vote acquisition in the electoral district (dapil) of West Sumatera 4 as stipulated in the General Elections Commission (KPU) Decree No. 360 of 2024 on the certification of the 2024 presidential and legislative election announced nationally on March 20, 2024.
The Petitioner stated that, in the tiered recapitulation process, discrepancies and differences were found in the C-result forms at the polling stations and the D-result forms of the subdistrict and regency election committees (PPK), up to the D-result form of the provincial election committee and the national D-result form. Through its witnesses, it had objected to the vote counting at the regency level in West Pasaman.
The Petitioner compared the difference in votes for PDI-P and the National Awakening Party (PKB) based on C-result copies and D-result forms in the West Sumatera 4 electoral district. It believes there was a reduction of 66 votes for PDI-P (C-result shows 27,379 while D-result shows 27,313), while PKB’s increased by 95 votes (C-result shows 27,231 while D-result shows 27,326). The Petitioner claimed there had been vote inflation at several polling stations in West Pasaman and Pasaman Regencies. Instead, there was vote reduction for PDI-P at several polling stations in both regencies.
Errors and omissions by the KPU (Respondent) have harmed the Petitioner’s valid votes, therefore, it has filed complaints to the Elections Supervisory Body (Bawaslu).
“We have filed objections as evidenced by special D-objection forms starting from the regency level. But they have not been resolved by the Respondent (Bawaslu),” said legal counsel Harli Muin for case No. 116-01-03-03/PHPU.DPR.DPRD-XXII/2024.
The Petitioner also alleges that recapitulation and vote count results by the Respondent were based on dishonest and unfair tiered tally in West Pasaman and Pasaman Regencies.
The Petitioner emphasized that based on C-result copies, there should be a difference of 148 votes, with a total of 27,379 votes for PDI-P and 27,231 votes for PKB according. Therefore, in the petitum, besides requesting the Court to invalidate the KPU Decree No. 360 of 2024, the Petitioner also requests the Court to establish the correct election results for the 2024 Regional Representative Council (DPRD) based on the Petitioner’s C-result copies, with a total of 27,379 votes for PDI-P.
