JAKARTA (MKRI) — The Constitutional Court of the Republic of Indonesia held a preliminary hearing for the Election Result Dispute filed by the National Mandate Party (PAN) for the selection of candidate members of the House of Representatives (DPR), Regional Legislative Councils (DPRD), and District/City Legislative Councils in Central Papua Province in the Central Papua Electoral District. The hearing took place on Monday (29/04/2024), led over by Constitutional Justice Arief Hidayat, accompanied by Constitutional Justice Anwar Usman and Enny Nurbaningsih. The petitioner, with Case Registration Number 82-01-12-36/PHPU.DPR-DPRD-XXII/2024, filed a request for the annulment of the General Election Commission's (KPU) Decision Number 360 of 2024 announced on Wednesday (20/03/2024)."
"This petition is filed regarding the Request for Annulment of General Election Commission decision Number 360 of 2024 for the selection of candidate members of the DPR throughout the Central Papua region," stated Azham Idamsyah, the legal representative of the petitioner.
The main issue in this dispute concerns the Central Papua region, specifically in three districts: Puncak District. According to the Petitioner's argument, the Petitioner should have received 22,760 votes. However, the General Election Commission (KPU) as the Respondent has set the count at zero (0) votes. Then, in Dogiyai District, the Petitioner should have received 9,143 votes. However, the count determined by the Respondent is zero (0) votes. Furthermore, in Intan Jaya District, the Petitioner's vote count should have been 52,000 votes, but the count set by the Respondent is zero (0) votes.
"In these three areas, the voting system used is the tied/Noken system," said Azham Idamsyah.
"In the petitum, the Petitioner's Legal Counsel expresses their hope that the Court will grant their Request in its entirety, namely to annul the General Election Commission decision Number 360 of 2024 regarding the 2024 Election Result Dispute filed by the National Mandate Party (PAN) for the selection of candidate members of the Members of the House of Representatives (DPR), Regional Legislative Councils (DPRD), and District/City Legislative throughout the Central Papua Electoral District, Central Papua Province. Furthermore, the Court is requested to correctly determine the vote counts for the National Democratic Party (Nasdem) and the Petitioner (PAN) according to the Petitioner, which are 157,978 votes for Nasdem and 203,629 votes for PAN."
