JAKARTA, MKRI - The Constitutional Court (MK) held a preliminary hearing for the election results disputes (PHPU) case filed by the National Democratic Party (Nasdem) for the election of the House of Representatives (DPR), Provincial Legislative Council (DPRD)/the Aceh Legislative Council (DPRA), Regency/City DPRD candidates for Central Papua Province, Mimika Regency DPRD Electoral District (Dapil) 5. The hearing Case No. 122-01-05-36/PHPU.DPR-DPRD-XXII/2024 was held on Monday, April 29, 2024 at the Court, presided over by the Constitutional Justices Arief Hidayat, Anwar Usman, and Enny Nurbaningsih. The NasDem filed a petition to cancel the General Elections Commission (KPU) Decree No. 360 of 2024.

The Petitioner’s legal counsel Ucok Edison Marpaung explained that there were discrepancies in the vote acquisition results between the Respondent and the Petitioner. According to the KPU Decree, NasDem received 4,142 votes, but the Petitioner claimed NasDem should have received 6,542 votes or a difference of 2,400 votes. however, the KPU certified that the National Awakening Party (PKB) received 5,702 votes, whereas the Petitioner argued that PKB only received 2,974 votes, indicating vote inflation.

"There is vote discrepancies in Telagapura District, namely the transfer and/or addition of 2,728 total votes for PKB from all polling stations (TPS) in Tembagapura District compared to the Tembagapura Regency District results," Ucok said at the hearing.

In addition, based on the discrepancies found above, the Petitioner's witness had informed the Respondent which was not followed up and the Petitioner recorded it in the special incident form at the Tembagapura District level.

In his Petitum, the Petitioner requests the Court to grant his petition entirely and annul the KPU Decree No. 360 of 2024 in relation to the vote acquisition of Mimika Regency DPRD 5. He also requests the Court to order the KPU to conduct a D-Results Form in Tembagapura District.
