JAKARTA (MKRI) — The Constitutional Court (MK) held the preliminary hearing for dispute over the results of the 2024 election of the DPR (House of Representatives), Provincial and Regency/City DPRD (Regional Legislative Council) of the electoral district (dapil) of South Tangerang 4 of Banten Province on Monday, April 29, 2024. The case No. 70-02-10-16/PHPU.DPR-DPRD-XXII/2024 was petitioned by the People’s Conscience Party (Hanura) candidate Kusrini Haidar Alwi.

In the petition, the Petitioner conveyed that the South Tangerang City Elections Commission’s (KPU) has certified the political party votes acquisition for the Regional Legislative Council (DPRD) election in electoral district 4 of South Tangerang outside the time period determined by law, thus it lacks legal certainty. Apart from that, the action did not comply with the Principle of Legality and General Principles of Good Government (AUPB) according to Law No. 30 of 2014 concerning Government Administration, in this case the Principle of Legal Certainty and the Principle of Accuracy.

According to the Petitioner, the content contained in KPU Decree Number 360 of 2024 as long as it concerns the results of the 2024 General Election for DPRD members of Tangerang City for South Tangerang Electoral District 4 was legally flawed from the start. This is because it is based on a legal product which also contains very serious legal flaws, namely a decision by the KPU South Tangerang City which was made and issued without legal basis in the context of Law No. 7 of 2017 regarding General Elections.

The Petitioner asserted that both the South Tangerang KPU Decree No. 287 of 2024 and the KPU Decree No. 360 of 2024 on the results of the 2024 election of Tangerang City DPRD and all of their legal consequences must be deemed null and void since their issuance.

The Petitioner emphasized that the South Tangerang City KPU Decree Number 284 of 2024 on the certification of the 2024 South Tangerang City DPRD election results to the political parties participating in said election dated March 6, 2024 is a legal product that must be considered null and void from the moment of its issuance along with all its legal consequences.
