JAKARTA (MKRI) — The Constitutional Court (MK) held the preliminary hearing for dispute over the results of the 2024 election of the DPR (House of Representatives), Provincial and Regency/City DPRD (Regional Legislative Council) of the electoral district (dapil) of South Tangerang 1 of Banten Province on Monday, April 29, 2024. The case No. 84-02-10-16/PHPU.DPR-DPRD-XXII/2024 was petitioned by the People’s Conscience Party (Hanura) candidate Ari Wibawa.

At the hearing chaired by Chief Justice Suhartoyo, the Petitioner’s legal counsel Horas A.M. Naiborhu said the South Tangerang City General Elections Commission (KPU) Decree No. 284 of 2024 on the certification of the recapitulation results of the 2024 South Tangerang City DPRD dated March 06, 2024 is a legal product that contains legal flaws since the time it was issued. He claimed that the procedure outlined in the laws and regulations was not followed during the vote counting, recapitulation, and certification of the results of the election of members of the South Tangerang City DPRD in 2024 for the electoral district of South Tangerang 1.

Therefore, the Petitioner requests the Court to grant the petition in its entirety by annulling the KPU Decree No. 360 of 2024.

“[The Petitioner requests that the Court] instruct the organizers of the 2024 election, following their respective authority, to hold a revote for the electoral district of South Tangerang 1 to elect members of the South Tangerang City DPRD and instruct the KPU to implement the decision,” Naiborhu said.
