JAKARTA (MKRI) — The Constitutional Court (MK) held the preliminary hearing for dispute over the results of the 2024 election of the DPR (House of Representatives), Provincial and Regency/City DPRD (Regional Legislative Council) of the electoral district (dapil) of South Tangerang City 5 of Banten Province on Monday morning, April 29, 2024 in the plenary courtroom. The case No. 77-02-10-16/PHPU.DPR-DPRD-XXII/2024 was petitioned by the People’s Conscience Party (Hanura) candidate Dedi Mohammad Rahmat.

At the hearing, the Petitioner’s legal counsel Horas A.M. Naiborhu argued that the certification of the results of the 2024 DPRD election for South Tangerang City was not conducted according to the procedure based on Law No. 7 of 2017 on General Elections. This was evident, he asserted, from the issuance and distribution of letter Commission No. 408/PP.07-Und/3674/2023 from the South Tangerang City General Elections dated March 19, 2024. Essentially, this letter invited parties to attend an evaluation meeting for the recapitulation of vote counting results for the 2024 South Tangerang City election, scheduled for March 21, 2024. However, it turned out that the event was the distribution of the South Tangerang City KPU (General Elections Commission) Decree No. 287 of 2024 on the certification of the 2024 South Tangerang City DPRD election results to the political parties participating in said election.

From matters described above, the Petitioner asserted, the vote counting, recapitulation, and certification of the 2024 DPRD election results for South Tangerang City electoral district 5 were not conducted according to the procedure established by statutory laws and regulations. Therefore, according to the Petitioner, a revote would be the best solution.
