JAKARTA (MKRI) — The Constitutional Court (MK) held a preliminary hearing for the 2024 legislative election of the DPR (House of Representatives), Provincial and Regency/City DPRD (Regional Legislative Council) on Monday morning, April 29, 2024 in the plenary courtroom. The petition No. 95-02-10-16/PHPU.DPR-DPRD-XXII/2024 was filed by Andy Maulana Syarif, a South Tangerang City legislative candidate of the electoral district (dapil) in South Tangerang 2 from the People Conscience Party (Hanura).

In his petition, the Petitioner stated the results of the 2024 South Tangerang DPRD election was carried out not in accordance with the procedure as regulated in Law No. 7 of 2017 regarding General Elections, as shown by the issuance and distribution of the South Tangerang City General Elections Commission (KPU) letter No. 408/PP 07-Und/3674/2023 on March 19, 2024. The letter essentially contains an invitation to attend the evaluation meeting for the recapitulation of vote counting results for the 2024 South Tangerang City election, which was held on March 21, 2024. However, the real event was the distribution of South Tangerang City KPU Decree No. 287 of 2024 on the certification of the 2024 South Tangerang City DPRD election results to the political parties participating in said election.

According to the Petitioner, the decree was made after a twenty-day deadline regulated in Article 413 paragraph (3) of Law No. 7 of 2017. As such, he argues, the vote counting, recapitulation, and certification of the 2024 South Tangerang City 2 DPRD election results were not carried out according to the procedure stipulated in the provisions of statutory laws and regulations. Therefore, he asserted, a revote is the most appropriate solution.

“Based on all the descriptions above, the Petitioner requests the Court to hand down the following decision to grant the Petitioner’s request in its entirety; to cancel the KPU Decree No. 360 of 2024 on the certification of the 2024 DPR and DPRD election results dated March 20, 2024 in relation to the electoral district in South Tangerang 2; to order the organizers of the 2024 general election according to their respective authorities to carry out a revote in South Tangerang 2 to elect members of the South Tangerang City DPRD; to order the KPU to implement the decision,” said the Petitioner’s legal counsel Horas A.M. Naiborhu.
