JAKARTA (MKRI) — The Change Movement Party of Indonesia (Garuda), the People’s Conscience Party (Hanura), and the United Indonesia Party (Perindo) filed general election results dispute (PHPU) petitions for the 2024 Regional Legislative Council (DPRD) election to the Constitutional Court (MK) on Saturday, March 23, 2024. Contesting political parties may file PHPU petitions for the legislative election of provincial and regency/city DPRD by province.
Hanura’s legal counsel is former constitutional justice of 2013-2017 Patrialis Akbar. His son, Adil Supatra Akbar, is part of the party’s legal team for West Kalimantan Province. Adil said the party requests the annulment of the General Elections Commission (KPU) decisions on several legislative candidates in several electoral districts.
“Some in provincial and regency DPRDs. Also, by our calculation, in several electoral districts in provincial and regency DPRDs, we lost seats due to miscalculation,” he said to the press after filing the petitions.
Meanwhile, Perindo’s legal counsel Pardo Sitanggang said the party filed petitions on North Sumatera Province and Samosir Regency. The petitioners claim that one of the polling stations had voted more than once, so they request a revote.
“We will also attach the Constitutional Court decisions on revote. So, the Court’s authority does not merely concern vote margins and it not only rejects or dismisses petitions, but the implementation of the Constitution must be observed,” Sitanggang stressed.
Garuda’s legal counsel Yustian Dewi Widiastuti said the noken system—where the chieftains cast vote for the tribe—was used in election in Intan Jaya Regency. However, the results were abolished despite the fact that on March 4 the Intan Jaya Regency Elections Supervisory Body (Bawaslu) had firmly annulled the regency’s plenary vote count results. However, the regency’s KPU disregarded Bawaslu’s recommendation to annul the results.
“So, [the candidate’s] votes by noken in the regency are now none. We request that Garuda’s votes be returned, since they were transferred to PAN, Golkar, and Nasdem,” she said.
Garuda filed a petition for Central Papua Province with the petition filing certificate (APPP) No. 03-01-11-36/AP3-DPR-DPRD/Pan.MK/03/2024. Hanura’s petition for West Kalimantan is recorded with APPP No. 04-01-10-20/AP3-DPR-DPRD/Pan.MK/03/2024, and for West Papua with APPP No. 05-01-10-34/AP3-DPR-DPRD/Pan.MK/03/2024. Meanwhile, Perindo’s petition for North Sumatera is recorded with APPP No. 06-01-16-02/AP3-DPR-DPRD/Pan.MK/03/2024.
Until 17:15 WIB, the Court has received 36 PHPU petitions for House of Representatives (DPR) and provincial and regency/city Regional Legislative Council (DPRD) and 4 for Regional Representatives Council (DPD) both on site and online. The parties that have filed PHPU petitions are the National Democratic Party (Nasdem), the Change Movement Party of Indonesia (Garuda), the People’s Conscience Party (Hanura), the United Indonesia Party (Perindo), the National Mandate Party (PAN), Aceh Adil Sejahtera (PAS Aceh) Party, the Crescent Star Party (PBB), and the Democratic Party. Candidate petitioners keep coming and are still registering with the administrators at the registration desks.
The Court has also received a presidential election dispute petition by Presidential and Vice Presidential Candidate Number 1 Anies Rasyid Baswedan-Muhaimin Iskandar. Meanwhile, the legal team for the Presidential and Vice Presidential Candidate Number 3 Ganjar Pranowo-Mahfud MD has arrived at the third building to file a presidential election dispute petition.
