JAKARTA (MKRI) — Employees of the Constitutional Court (MK) who are members of the Task Force participated in a series of simulations of general election results in dispute resolution (PHPU) on Wednesday, March 6, 2024, at Building One, Two, and Three. During the opening, Chief Justice Suhartoyo said today's simulation was a partial accumulation of MK’s preparation ahead of election case handling. Then, Suhartoyo added that today’s simulation was an unseparated part of other partial simulations starting in January 2024. It is because today, all parts of the PHPU handling process would be sequentially practiced, both for presidential and legislative elections.
“So, we want in this simulation, all technical and nontechnical issues can be handled well and anticipatively because everything has been practiced,” Suhartoyo mentioned during the opening, which was also attended by the Chairman of MKMK, I Dewa Gede Palguna, Member of MKMK, Yuliandri; Secretary-General, Heru Setiawan; BPKP Ikhwan Mulyawan; BPS Atqo Mardiyanto; as well as MK’s structural and functional officials at Delegation Room, Fourth Floor, MK Building One.
Deeper Understanding
Secretary-General Heru Setiawan, in his report, said that the simulation involved all members of the Task Force and presented the head and deputy head of the department at all stages. There was a role play for the pre-registration stage of Presidential Elections PHPU handling, starting from petition submission, registration, and data processing, held at MK Building Three Lobby. Meanwhile, the simulation for pre-registration of Legislative Election PHPU handling will begin with petition submission, revision submission, data processing, and registration. Then, today, simultaneously, simulation on the post-registration for Legislative and Presidential Elections PHPU handling will be practiced until the post-decision stage.
“Later, we will prepare casts to act in presidential and legislative elections case handling settings. Hence, today’s agenda can give a deeper understanding of the MK Law and Regulation so that it is close to the real practice. Starting from pre-registration, post-registration, to post-decision,” Heru mentioned.
Improving Data Value
Before the simulation, at two separate places, namely Building Three Lobby for Presidential Elections PHPU simulation and Building Two Lobby for Legislative Elections PHPU simulation, the heads and deputy heads of the department listened to the National Statistics Agency (BPS) presentation and Financial and Development Supervision Agency (BPKP). During a presentation titled “Data Processing and Visualization,” the Head Secretary of BPS, Atqo Mardiyanto, explained how data could have simultaneous values and contributions for stakeholders/decision makers. Statistics are not just numbers in order; it includes case data in MK. When data turns into a cycle, it will generate various decisions that can be used.
“Data is not the whole story; data is like a puzzle to sort, then how to redefine the numerical product then turn it into something that can be used. It is hoped that data can increase the value of existing data. Hence, the data is sound and can be read and understood to decide based on formulated data,” Atqo explained during a presentation moderated by Dian Dwi Hapsoro from MK’s Inspectorate.
Furthermore, the Director of the Politics and Law Enforcement Department of BPKP, Ikhwan Mulyawan, delivered his presentation titled “The Strengthening of Government Internal Control (SPIP) and Risk Management during the PHPU Case Handling 2024”. Ikhwan explained that SPIP is mandated by Law Number 1 of 2004 of State Treasury, Article 58(1) and (2), later embodied under the Government Regulation Number 60 of 2008 on the Government Internal Control System.
On MK’s authority, Ikhwan added that the implementation of SPIP can be used on the percentage of judicial review, state institutions dispute cases, and other cases that have been decided, including its time frame, also applied for the 2024 PHPU cases.
“So, risk identification during the 2024 PHPU case handling is under MK’s control in the form of vote result of political parties and the presence of commotion on the determination of elected officials,” Ikhwan mentioned.
Self Evaluation
From morning until afternoon, ahead of the simulation to prepare for PHPU case handling, MK registrar Muhidin concluded the event officially at the Ground Floor Hall of MK Building One. Muhidin mentioned several notes on the simulation.
“Self-evaluation is needed starting from the petition submission process until the conclusion of the cases. I hope it can be overcome, especially by department coordinators, since no simulation will occur. By saying Alhamdulillahirabbilalamin, this simulation is officially concluded,” Muhidin said, closing the simulation.
