UIB Student Affirm Argument on Court’s Authority on Party Disbandment

JAKARTA (MKRI) — Risky Kurniawan, a Batam International University student, attended the petition revision hearing for the material judicial review of Article 68 paragraph (1) of Law No. 24 of 2003 on the Constitutional Court virtually on Tuesday, February 27, 2024. The second hearing for case No. 17/PUU-XXII/2024 on the provision that stipulates only the Government can petition for the disbandment of political parties took place in the plenary courtroom.

Legal counsel Otniel Raja Maruli Situmorang conveyed the revisions to the petition, one of which was the elaboration of the Court’s authority over the review of the article being petitioned.

“Other revisions are the background of the petition and the legal standing. We have strengthened both with arguments,” Situmorang said before Deputy Chief Justice Saldi Isra (panel chair) and Constitutional Justices Enny Nurbaningsih and Daniel Yusmic P. Foekh.

At the preliminary hearing on Tuesday, February 13, the Petitioner stated that the a quo article could potentially harm the Petitioner’s constitutional right as to defend the state pursuant to Article 9 of Law No. 3 of 2002 on State Defense, he wishes for political parties that have allegedly been involved in corruption be disbanded. The Petitioner believes it is insufficient that the authority to disband corrupt political parties be granted only to the Government. Individual citizens, he argues, should be granted such authority.

Therefore, The Petitioner appeals to the Court to declare Article 68 paragraph (1) of Law No. 24 of 2003 on the Constitutional Court unconstitutional and not legally binding if not interpreted as “The Petitioner shall be the Government or Individual Indonesian Citizens.”
