JAKARTA (MKRI) — The Constitutional Court Ethics Council (Majelis Kehormatan Mahkamah Konstitusi or MKMK) held a Petitioners’ Clarification Meeting on Wednesday (21/2/2024). The agenda of this meeting led by the Head of MKMK, I Dewa Gede Palguna, was to clarify the reports of several petitioners received by the Secretariat of MKMK from November to December 2023 and January 2024. The report was submitted by Zico Leonargo Djagardo Simanjuntak (Complainant I), Alvon Pratama Sitorus (Complainant II), Andi Rahadian from Friends of the Constitution (Complainant III), Andika Ujiantara and Andu Sutan Abdillah Harahap from Justice Youth Alliance (Complainant IV), and Harjo Winoto from Rahnoto and Partner (Complainant V)

The clarification meeting held at the Courtroom on the 4th floor of MK Building 2, Jakarta, was attended in person by Zico Leonard Djagardo Simanjuntak (Complainant I) Eliadi Hulu as legal counsel of Alvon Pramata Sitorus and Junaldi Malau (Complainant II), and Andi Rahadian from the Friends of Constitution (Complainant III). Meanwhile, other complainants, namely Andi representing Andika Ujiantara and Andu Sutan Abdillah Harahap from Justice Youth Alliance (Complainant IV) and Harjo Winoto from Rahnoto and Partners (Complainant), attended online.

Referring to MK’s Regulation No. 1 of 2023 on the Ethics Council of the Constitutional Court (PMK 1/2023), the clarification meeting was closed to the public. The clarification meeting was intended to affirm the complainants’ positions on the proceedings of their report submitted to the council.

The reports being discussed then had been submitted to MKMK when it was still an ad hoc council led by MKMK’s head, Jimly Asshiddiqie. Hence, MKMK, now led by I Dewa Gede Palguna from 8 January - 31 December 2024, must ensure the formal procedural law that complainants must prepare based on the existing regulations. Later, complainants will be given information on the proceeding of the reports, whether it will be registered or not.

On November 7, 2023, the ad hoc MKMK handed down decisions on ethical violations committed by the constitutional justices. One of the decisions recommended the establishment of a permanent MKMK.

The Court announced the plan to establish a permanent Ethics Council on Wednesday, December 20, 2023. Based on the Constitutional Court Regulation (PMK) No. 1 of 2023 on the Constitutional Court Ethics Council, the Ethics Council shall consist of three people: one constitutional justice, one public figure, and one academic with a background in law. Their term of office spans January 8 to December 3, 2024.

Constitutional Justice Ridwan Mansyur represents active constitutional justices, I Dewa Gede Palguna (constitutional justice for 2003-2008 and 2015-2020) represents public figures, while Yuliandri as an academic from Andalas University represents academics with a background in law.
