JAKARTA (MKRI) — The Petitioner of case No. 7/PUU-XXII/2024, a student named Adoni Y. Tanesab, has retracted his petition of Article 29 paragraph (1) letter a of Law No. 48 of 2009 on the Judicial Power. In the petition, he requested that the Constitutional Court (MK) review its decisions that have been declared in violation of code of ethics.

He requested the Court to interpret the word “laws” in the article to include Constitutional Court decisions whose examination and decision-making process has been declared in violation of the principles of independence and impartiality in the constitutional justices’ code of ethics and conduct (Sapta Karsa Hutama) based on the decisions of the Constitutional Court Ethics Council (Majelis Kehormatan Mahkamah Konstitusi or MKMK). However, after considering the justices’ advice at the preliminary hearing, he decided to retract his petition.

“We sent a letter dated February 9, 2024 on the retraction of case No. 7/PUU-XXII/2024 on the ground that after we considered the Excellency Justices’ advice and observed the Constitutional Court’s authority, both in the 1945 Constitution and Law No. 48 of 2009, we decided to retract the petition,” said legal counsel Marthen Boiliu at the hearing set to confirm the petition’s retraction, which took place in the plenary courtroom on Monday, 19 February 2024.

The hearing was presided over by Deputy Chief Justice Saldi Isra (chair) with Constitutional Justices M. Guntur Hamzah and Ridwan Mansyur. Justice Saldi affirmed that the Petitioner had retracted the petition.

“So, this is clear, Mr. [Boiliu], that the petition is retracted. If you have more ideas, you can reconsider filing it again, of course by registering another petition,” he said before adjourning the hearing.
