JAYAPURA (MKRI) — A total of 53 administrators and members of the Indonesian Advocates Association Suara Advokat Indonesia (Peradi SAI) of Jayapura City attended a workshop on the procedural law for the 2024 general election results disputes (PHPU) on Monday, December 11, 2023 in Jayapura. In his opening remarks, Deputy Registrar Triyono Edy Budhiarto said that the success of the implementation of the Constitutional Court’s (MK) authority in deciding disputes over election results is not only determined by the readiness of its apparatus, but also by the knowledge and understanding of various parties in the 2024 PHPU.
“Based on this idea, the Court through the Pancasila and Constitution Education Center (Pusdik) considers it necessary to hold workshops on the procedural law for the 2024 general election results disputes for political parties, DPD candidates, and presidential tickets as general election participants; as well as the General Elections Commission, the Election Supervisory Agency, and advocates who will later become the legal counsel of the parties in the Court hearings,” said Edy before the participants as well as chairman of Jayapura City branch executive board of Peradi SAI Anthon Raharusun and Papua Governor’s advisor for community and human resources Elsye Rumbekwan.
When the parties who will file cases to the Court understand the procedure for resolving the 2024 PHPU cases, Edy continued, the Court can resolve any disputes smoothly, fairly, with dignity, and constitutionally. In addition, this is also in line with the election organizers’ commitment to hold elections peacefully, honestly, fairly, and in accordance with statutory laws and regulations.
Good Litigation Process in Constitutional Court
In her speech, Papua Governor’s advisor for community and human resources expressed gratitude to the Court for organizing the workshop since in 2024, Indonesia, including the people of Papua, will participate in organizing the 2024 election.
“I express my gratitude and appreciation because through this event, I hope that future disputes can be resolved effectively and ease the burden of regional heads who serve temporarily in overseeing the 2024 election. Therefore, the participants can communicate optimally in resolving disputes and later be able to proceed well in the Constitutional Court, especially understanding the procedure in resolving the 2024 PHPU in the Constitutional Court,” she said.
Litigating Skills
In his welcoming remarks, chairman of Jayapura City branch executive board of Peradi SAI Anthon Raharusun stated that because there is a time limit that must be met in the settlement of PHPU in the Constitutional Court, which is 3x24 hours, good litigating skills are needed to understand the procedural law for it.
“In addition, it is also necessary for the parties to understand the techniques and practices of preparing the petition, preparing the respondent’s answer, and preparing the relevant party’s statement in handling election dispute cases in the Court,” he said.
The workshop took place for two days from Monday-Tuesday, December 11-12, 2023 in Jayapura. At this event, the participants will be given materials on the procedural law of the 2024 PHPU cases; the dynamics of handling PHPU cases; the mechanism, stages, and schedule of the resolution of the 2024 PHPU cases; techniques, practice, and evaluation of drafting the Petitioner’s petition and relevant party statement for the 2024 PHPU; and the utilization of information technology in handling the 2024 PHPU cases.
