JAKARTA (MKRI) — Students of the Faculty of Law of Parahyangan Catholic University visited the Constitutional Court (MK) on Thursday, November 23, 2023. As many as 72 students were welcomed by expert assistant to constitutional justice (ASLI) Winda Wijayanti at the Court’s second hall.
On this occasion, Winda delivered a presentation on “The Development of Procedural Laws of the Constitutional Court.” She explained the history of the Constitutional Court’s formation. “There were problematic laws but there was no constitutional review mechanism,” she said.
The next reason for it is because presidential impeachment was only for political reasons and there were frequent conflicts between state institutions or government agencies. In addition, there was no clear forum for resolving disputes over election results and the mechanism for dissolving political parties through the Supreme Court was also not very clear.
Next, Winda revealed that by November 13, the Court had decided 1,721 judicial review cases or 48,32 percent out of all of its cases. Meanwhile, the most challenged law is the Election Law, with the provision relating to the age limit of presidential and vice presidential candidates being the most petitioned.
She believes that the high number of petitions against the Election Law related to the age limit of presidential and vice-presidential candidates can be an idea for research by students. This age limit is not regulated in the 1945 Constitution, or is an open legal policy.
“The Constitutional Court declared the age limit for a presidential candidate conditionally constitutional. They may be under 40 years old if they have served as a regional head,” she said.
Winda added that the Constitutional Court is the final solution to constitutional problems. “Because the Constitutional Court’s decisions are final and binding. When it already passes a decision, the petition cannot be re-submitted. A similar petition can be submitted but with a different touchstone,” she said.
