JAKARTA (MKRI) — Newly-elected Chief Justice Suhartoyo (2023-2028) officially opened the fourth workshop on the procedural law for the resolution of the 2024 general election results disputes (PHPU) for the General Elections Commission (KPU) on Tuesday evening, November 14, 2023 in Jakarta.

In his speech, Chief Justice Suhartoyo said that the development of democracy and elections is a process that must be interpreted positively, although the development has also created a highly complex issues, not only in the process of implementing the election, but also settling disputes after the vote recapitulation.

“The KPU is a pillar of democracy and a key player for the implementation of a successful and democratic 2024 Election. For this reason, this workshop was held by the Constitutional Court, with the hope of building synergy between state administrators and democratic institutions, in order to build a democratic state by law,” he said.

He appealed to all KPU officials to maintain integrity in the democratic process to achieve expected election results. Therefore, cooperation and synergy of all elements of society are crucial to the success of the election in order to maintain the sovereignty of the people.

“In cases that occur before the settlement of disputes over election results, we can work together. But if it [is brought to] the Constitutional Court, then [stakeholders] cannot (synergize). What can be done is complying with procedural law and making it a tool of evidence for the petitioners,” he explained.

In addition, he explained that the Constitution has mandated the implementation of election be direct, public, free, confidential, honest, and fair. BY following these principles properly, the election process will be well-organized, and the results can also give rise to a good succession of leadership.

At the end of his remarks, Chief Justice Suhartoyo said that the workshop was aimed at the success of all stages of the election, which will be a national event. The PHPU resolution is the final stage of the election, which will be held simultaneously on February 14, 2024.

Head of the Planning and Implementation Division of the Pancasila and Constitution Education Center (Pusdik) of the Constitutional Court, Nanang Subekti, gave his remarks on behalf of the Secretary-General of the Constitutional Court. He explained the curriculum of the workshop. “The Pancasila and Constitution Education Center of the Constitutional Court has compiled a curriculum and division of each cluster which is used as a basis for speakers to deliver learning materials,” he said.

The fourth batch of the workshop on procedural law for PHPU settlement in 2024 for the KPU will take place from Tuesday to Thursday, November 14 to 16, 2023. This time, there are 354 participants, consisting of officials and staff of the regency and city KPU.

The objectives of this event is to improve understanding and equalize public perceptions of the Constitution and the procedural law of the Constitutional Court, increase knowledge and understanding of the procedural law for resolving disputes over general election results in 2024.

The curriculum for the workshop covers the procedural law for the 2024 PHPU; potential disputes in the 2024 Election; the dynamics of handling of disputes over general election results; the mechanism, stages, and activities of handling the 2024 PHPU cases, the preparation of the respondent’s response in the 2024 PHPU; the preparation of the respondent’s response over the 2024 PHPU relating to the legislative election; the electronic case handling information system and the evaluation of the results of the preparation of the respondent’s response—which will be divided into clusters.
