BOGOR (MKRI) — Head of the Program and Implementation Division of the Constitutional Court’s Pancasila and Constitution Education Center (Pusdik) Nanang Subekti closed the fourth workshop on the procedural law for the 2024 general election results disputes (PHPU) for advocates affiliated with the Congress of Indonesian Advocates (KAI) on Thursday, November 2, 2023 at the Pancasila and Constitution Education Center (Pusdik) in Cisarua, Bogor, West Java Province.
In his closing remarks, Nanang conveyed that advocates give key inputs to the Court. “So, justice or the enforcement of the truth is really determined by [advocates], especially during disputes over election results. It is certain that whatever judicial decision is always considered correct and must be implemented. So, inevitably the truth is in the hands of advocates. And from this workshop, ladies and gentlemen, you really get an understanding of how to litigate in the Constitutional Court, at least how to present strong evidence,” he said.
He also said that next year the Center will hold other workshops on regional head election (pilkada) disputes, for which the Court is only given 3 months to settle. “Therefore, we will invite KAI to come back to Pusdik to participate in the workshop. However, in 2025, we will specifically invite KAI to take part in workshop on judicial review,” he stressed.
Previously, KAI president Siti Jamaliah Lubis had expressed her gratitude to the Court for conducting the 2024 PHPU workshop. “Hopefully with this event, there will not be many disputes that go to the Constitutional Court. We want this election to be peaceful. Don’t pray that there will be many disputes. And we thank the Constitutional Court again, who always invites KAI to workshops,” she said.
One of the participants, Khoaimin, conveyed his impression of the workshop. He gave positive feedback on it, and said he had had extraordinary experience and gained useful knowledge from it. “The speakers’ presentations were credible and they have the capacity and competence in their respective fields, so they have extraordinary abilities in theory and practice,” he said.
However, he hoped this workshop can be implemented during general election results disputes in 2024 because advocates have a noble duty in election, particularly assisting individuals in exercising their constitutional rights and obtaining justice. Advocates are expected to work hard and to always maintain honesty and integrity in carrying out their duties, particularly in relation to the 2024 general election results disputes, which will have a significant impact on Indonesia’s democracy.
“All participants of the workshop are expected to build synergy between state administrators and democratic institutions in order to realize the mandate of the 1945 Constitution in order to build a democracy based on law and at the same time so that we can all oversee the democratic process with principles in accordance with the Constitution and applicable laws and regulations. This workshop is certainly concrete evidence of the synergy between the Constitutional Court and KAI. This collaboration is certainly one of the strategic steps to improving the understanding and quality of advocates in handling very complex PHPU cases,” she concluded.
This workshop took place on Monday, October 30 to Thursday, November 2, 2023 with 160 participants that are advocates affiliated with KAI.
