Bawaslu’s Important Role in Election Dispute Hearings

SEMARANG (MKRI) - In preparation for the 2024 simultaneous election, the Constitutional Court (MK) in collaboration with the Election Supervisory Body (Bawaslu) of Central Java Province held a workshop on the procedural law for 2024 election results disputes (PHPU) on Friday, October 27, 2023 in Semarang.

Constitutional Justice Suhartoyo, who delivered a presentation, explained the parties who are entitled to submit a PHPU case. In this case, Bawaslu must pay attention to its position as a party that can provide information on its supervision of the election process.

At the Constitutional Court’s hearings, Bawaslu delivers statements on the cases. The Constitutional Court will coordinate with the central and regional Bawaslu on the cases.

“What needs to be explained in the statement is the chronology which the Petitioner argues about and what steps Bawaslu has carried out. I am sure that all of you from Bawaslu can really be straightforward and firm in dealing with cases,” said Justice Suhartoyo.

Bawaslu as Informant

In his opening remarks, Secretary-General of the Constitutional Court Heru Setiawan said that the workshop was carried out in order to explain Bawaslu’s role in the Court’s hearings as an informant on violations that occur during the election process. Through this workshop, the Constitutional Court wanted to ensure that Bawaslu, as a party present at polling stations during the election, can provide evidence that can be brought to the hearings.

“So that [Bawaslu] not only make reports and notes of incidents, but also contributes to the success of democratic elections,” Heru said.

Knowledge on Supervision

In his remarks, chairman of the Central Java Bawaslu Muhammad Amin said that soon the election will begin with campaigns, so Bawaslu in has begun to prepare for its supervisory role. One of them is by attending this workshop.

“[This strong collaboration] between Bawaslu and the Constitutional Court is a rare opportunity and [we] should participate in it until the end. [I] hope [Bawaslu members] will be able to carry out supervision with the knowledge that has been obtained in today’s classes,” he said.

This workshop will be held for two days, Friday-Saturday, October 27-28, 2023 in Semarang. On this workshop, the participants not only received materials but also were given a practical lesson in drafting a statement to present when submitting an election monitoring report. They will be guided by substitute registrars and expert assistants of constitutional justices to draft statements for presidential election dispute cases.
