Advocates’ Role of in Ensuring Quality, Fair Decisions

BOGOR (MKRI) — The legal maxim res judicata pro veritate habetur means a thing adjudged is regarded as truth and must be implemented. In other words, every decision of the constitutional justices must be implemented. In this context, advocates as the closest friends of the Court are required to be able to provide legal opinions and express legal ideas properly, so that the Court’s decisions can reflect justice.

The statement was made by the head of the Program and Implementation Department of the Pancasila and Constitution Education Center Nanang Subekti at a workshop on the procedural law for the 2024 general election results disputes (PHPU) on Monday, October 23, 2023 at the Pancasila and Constitution Education Center (Pusdik) in Cisarua, Bogor, West Java Province. The participants were advocates of four organizations: the Luhut Pangaribuan Indonesian Advocates Association (Luhut Pangaribuan Peradi), the Association of Indonesian Advocates (Peradin), the Indonesian Advocates Association (AAI), and the Indonesian Advocates Society (Ikadin).

“This is the important role of advocates to the Court and therefore this workshop is held. The Pusdik team will continue to develop curriculum so there will be levels [for the workshop]. For example, after the workshop on filing a petition, there may also be one on how to prepare legal standing. So, we ask advocates to give us feedback on this event,” said Nanang at the closing ceremony, which was also attended Peradin central executive body chairman and secretary-general Firman Wijaya and Hendrik Eddy Purnomo.

The event was held from Monday to Thursday afternoon, October 23-26, 2023 at the Constitutional Court’s Pancasila and Constitution Education Center (Pusdik). The advocates listened to presentations on the procedural law for the 2024 general election results disputes (PHPU) by selected speakers, including Constitutional Justice Wahiduddin Adams, Constitutional Justice Enny Nurbaningsih, and substitute registrars and expert assistants to constitutional justices. The advocates did not only learn theories, but also practice preparing a petition and the relevant party’s statement for the 2024 PHPU, facilitated by case study experts.
