JAKARTA (MKRI) — For the past week, the Constitutional Court (MK) has received reports of alleged ethical violations by constitutional justices. In response, it formed and officially inaugurated Majelis Kehormatan Mahkamah Konstitusi (MKMK) or the Constitutional Court Ethics Council.
The council’s formation inauguration is recorded in the Decree No. 10 of 2023 om the formation and composition of the membership of MKMK in 2023, dated October 23, 2023. The letter stipulates that the members of the councils are Wahiduddin Adams, Jimly Asshiddiqie, and Bintan R. Saragih. Wahiduddin Adams represents the constitutional justices, Jimly Asshiddiqie represents community figures, while Bintan R. Saragih represents law academics. The MKMK will be working for a month since October 24 until November 24.
The inauguration took place in the Court’s second hall on October 24, 2023. The three members took their oath led by Chief Justice Anwar Usman. After being sworn-in, they signed a letter of duty before Constitutional Justice Enny Nurbaningsih, Chief Registrar Muhidin, Secretary-General Heru Setiawan, and the Court’s structural and functional officials.
“We have witnessed the formation and swearing-in of members of the MKMK. It is a body that the community has waited in response to recent news about the Constitutional Court. This is the Court’s effort to uphold the constitutional justices’ constitutionality in upholding justice. The public and I hope the MKMK can execute its duty well for the honor of the Constitutional Court,” the chief justice said.
The formation of the MKMK is the mandate of Article 27A paragraph (2) of Law No. 7 of 2020 on the Constitutional Court, which reads, “In order to enforce the Code of Ethics and the Code of Conduct for Constitutional Justices as referred to in paragraph (1), a Constitutional Court Ethics Council shall be formed….” Following up on the provision, on February 3, 2023, the Constitutional Court issued the Constitutional Court Regulation (PMK) No. 1 of 2023 on the Constitutional Court Ethics Council. The council consists of one constitutional justice, one community figure, and one academic having a background in law.
MKMK Secretariat
For optimum performance, the MKMK Secretariat was formed. Head of the Legal Affairs and Registrar’s Administration Bureau Fajar Laksono was appointed its chairperson. The secretariat’s formation is recorded in the Decision of the Secretariat General of the Constitutional Court No. 501 of 2023 on the Secretariat of the Constitutional Court Ethics Council of 2023-2026.
In addition, the Court appointed several employees—consisting of IT officers, transcribers, and Public Relations officers—to provide technical support for the implementation of the council’s duties in 2023.
