JAKARTA (MKRI) — Fifty students of SMA (Senior High School) Annajah of Bogor visited the Constitutional Court (MK) for a study tour on Wednesday, October 4, 2023. They were welcomed by expert assistant to constitutional justice Kikisyabana Yulistyaputri.

Kiki began her presentation by talking about the background of the Court’s establishment, authority, and obligation. “The Court has the authority to conduct judicial review of laws against the Constitution, to decide authority disputes between state institutions whose authority is granted by the Constitution, to decide the disbandment of political parties, and to resolve disputes over general election results,” he stated.

Based on its authority, the Court has several roles and functions, i.e. the guardian of the Constitution, the final interpreter of the Constitution, the protector of democracy, the guardian of the citizens’ constitutional rights, the protector of human rights, and the guardian of the state ideology.

Kiki also explained the nine constitutional justices and the state institutions that nominated them. “The constitutional justices are appointed by three institutions: the House of Representatives, the Supreme Court, and the President. However, they must undergo a fit and proper test,” she continued.  

Kiki also explained who can file a judicial review petition of laws to the Constitutional Court. The Constitutional Court Regulation (PMK) stipulates that individual Indonesian citizens, customary law community units that live in accordance with the development of society and the principles of the Unitary State of the Republic of Indonesia as regulated by laws, public or private legal entities, and state institutions that feel their constitutional rights and/or authorities have been violated by the enforcement of laws can file a judicial review petition to the Court.

After delivering the presentation, Kiki opened a question-and-answer session for the students and engaged them in a discussion on Indonesia’s constitutional system.

Next, the students were invited to visit the Constitution History Center (Puskon) on the 5th and 6th floors of the Court’s main building. They observed the Center, which was inaugurated on December 19, 2014 by current President Joko Widodo, in more details. They toured the Center’s six zones—the pre-independence zone, the independence zone, the 1945 Constitution zone, the zone on the Constitution of the Republic of the United States of Indonesia (RIS), the zone on the Provisional Constitution of 1950, the zone on the Return to the 1945 Constitution, the Reforms zone, and the Constitutional Court zone.
