JAKARTA (MKRI) — The Constitutional Court (MK) held the second hearing on judicial review of Article 169 letter q of Law No. 7 of 2017 on General Elections (Election Law) on Tuesday, October 3, 2023 in one of the panel courtrooms. The hearing was to examine the revised petition for case No. 105/PUU-XXI/2023, with Deputy Chief Justice Saldi Isra and Constitutional Justices Arief Hidayat and Manahan M.P. Sitompul presiding.

“Today’s hearing is to hear the revised petition. However, the legal counsel has withdrawn the petition. At today’s hearing, [the Court] would like to ask confirmation of the withdrawal, but the Petitioners are not present and one of them has confirmed the withdrawal. It will be decided in a justice deliberation meeting that a hearing has been held and the Petitioners are not present and the Court has received the letter of withdrawal request,” said Justice Saldi.

At the preliminary hearing on September 20, Petitioners Soefianto and Soetomo Hermanda expressed their wish that the phrase “maximum age” be added to Article 169 letter q of the Election Law. Soefianto said that in some countries, it is possible for presidential and vice-presidential candidates to be over the age of 70, which he believes is not an optimal age for them to be carrying out their duties. The Petitioners believe the law in Indonesia specifically regulates the minimum age limit of state civil apparatuses, military officers, police officers, and private employees by setting their retirement age. They argue that lack of regulation or clarification of the maximum age restriction for running as presidential/vice-presidential candidates in the a quo article has violated their constitutional rights.
