JAKARTA (MKRI) — The Constitutional Court and the Coordinating Ministry for Political, Legal, and Security Affairs (Kemenkopolhukam) signed a memorandum of understanding (MoU) to strengthen coordination and policy control of ministries and institutions through policy studies in the fields of politics, law, and security based on constitutionalism. Representing both institutions to sign the MoU were Secretary-General Heru Setiawan and Secretary Teguh Pudjo Rumekso, with Chief Justice Anwar Usman and Minister Mahfud MD as witnesses. The event took place on Tuesday, October 3, 2023 in the lobby of the plenary courtroom.
The MoU focuses on many points, such as coordination, synchronization, and policy control in the fields of politics, law, and security based on constitutionalism to strengthening both institutions. The two institutions also agreed on exchanging data and/or information on academic studies and publications on the implementation of the principles of constitutionalism in the fields of politics, law, and security.
In his speech, Coordinating Minister for Political, Legal, and Security Affairs (Menkopolhukam) Mahfud MD expressed hope that this cooperation would not be misinterpreted as interference between the judiciary and the legislature. “This is cooperation between the Court and Kemenkopolhukam as bureaucracy. Therefore, it was signed by the Court’s secretary-general and the Ministry’s secretary,” he said.
He said he was touched because today he could come to the Court after leaving the office of a constitutional justice around 11 years ago. “In this building, landmark decisions and other monumental decisions were made,” he said.
In 2008, Mahfud MD was elected a constitutional justice through nomination by the House of Representatives (DPR). He was also elected a chief justice for two periods in 2008-2011 and 2011-2013.
He hoped that this MoU can be implemented well. “Mr. Secretary-General and Mr. Secretary, please execute this MoU well, because it is very important for the development of law in Indonesia,” he said.
In his speech, Chief Justice Anwar Usman expressed his appreciation for the two institutions’ initiative in establishing cooperation. “This MoU is not intended as a platform for mutual intervention, but rather to facilitate the judiciary to uphold law and justice. Hopefully this cooperation will be carried out earnestly by the Court’s secretary-general and the Ministry’s secretary, particularly in the field of remote judicial system,” he said.
