YOGYAKARTA (MKRI) — Chief Justice Anwar Usman officially opened a focus group discussion (FGD) on “Monitoring and Evaluation of the Implementation of Constitutional Court Decisions in 2023” on Thursday, September 7, 2023 in Mataram City International Convention Center of the Ayana Hotel, Yogyakarta City. It was collaboration between the Constitutional Court (MK) and the Center for Law and Policy Studies (PSHK) of the Law Faculty of the Islamic University of Indonesia (FH UII).
In his opening remarks, the chief justice expressed his pride as it was the first time the Court’s FGD had complete attendance, especially of UII’s constitutional law expert Prof. Dr. Ni’matul Huda, S.H., M.Hum., who is a pioneer on the development of legal issues.
The hybrid FGD was opened with a presentation by Mushaddiq Amir from the National Development Planning Agency (Bappenas) as the organizer of government affairs on national development, which aims to address the implementation of the Constitutional Court’s decisions, especially the 4 decision clusters.
“The majority of the Court decisions that grant judicial review petitions have not been followed up by the legislators or the government,” he said.
Meanwhile, head of the Court’s Legal and Administrative Bureau Fajar Laksono delivered a report speech. “Today, we invite more than 130 people consisting of stakeholders, petitioners, experts, and government related to regulations and laws, as well as researchers,” he said.
Fajar added that the FGD is the Court’s platform to listen to situations after its decisions are pronounced. “It is not to debate the substance of the decisions that have been delivered, but rather to observe their implementation,” he stressed.
The FGD take place on September 7-9, 2023. The aim is to listen to the stakeholders and evaluate the implementation of the Constitutional Court decisions regarding the 4 clusters—relating to marriage among coworkers, the religion column in KTP (resident identity card), DPR’s (House of Representatives) involvement of in the ratification of treaties, and the civil status of children born outside of wedlock.
The FGD participants are staff of the Constitutional Court, petitioners of relevant decisions; researchers; academics; experts; the Ministry of Home Affairs; the Ministry of Education and Culture, Research, and Technology; the Ministry of Manpower; judicial institutions; and other state Institutions/agencies.
