Court Facilitates Access to and Understanding of Its Decisions

BEKASI (MKRI) —  Chief Justice Anwar Usman opened a meeting to discuss and finalize annotations based on the Constitutional Court’s (MK) decisions, landmark decisions, and summaries of decisions of 2023 in Bekasi, West Java Province on Thursday, August 28, 2023. In his remarks, he said the Court received a lot of attention from the public relating to the implementation of its duties and authority.

He said that despite a lot of negative sentiment and judgement of the Court’s decisions, the Court’s employees must be free from external influences.

“When the Court’s decisions do not align with [public] interest, criticisms arise. But if its decisions align with [public] interest, the Court receives praises,” he said.

The chief justice stressed that the Court is one of the institutions that the public expect to provide solutions to constitutional issues. Its strategic role in ensuring the enforcement of law and justice requires all of the employees’ professionalism and dedication. He believed this meeting aimed at providing justice seekers with access to the Court’s decisions and help them understand those decisions.

Inventory of Decisions

Prior to the chief justice’s remarks, chief registrar Muhidin said the meeting would also discuss the draft of the regulation of the Minister of Administrative and Bureaucratic Reform on the functional positions (jabatan fungsional) in the Court’s Registrar’s Office, which followed up on one of the Court’s decisions, and the development of the IT-based system for the general election results disputes (PHPU) settlement.

He also reported that in order to disseminate information and help the public understand information relating to the Court’s decisions, the Court has made an inventory of the decisions where the Court granted the petitions as well as landmark decisions that the public must be made aware of.

The inventory was made based on the laws petitioned to the Court. Annotations to those laws were then made to indicate that there have been rulings to declare their contents unconstitutional and not legally binding, conditionally constitutional, and conditionally unconstitutional. These annotations on the Court’s decisions are then released as a book.

“Presentations by speakers and a simultaneous discussion with the participants are expected to provide insights on the methods to drafting law annotations based on Constitutional Court decisions, landmark decisions, and decision summaries and on the regulation of the Minister of Administrative and Bureaucratic Reform on the functional positions in the Registrar’s Office; as well as to help developing the system for general election results disputes (PHPU) settlement,” he said.

He added that a representative of the Ministry of Education and Culture also delivered a presentation on the Perfected Spelling of the Indonesian Language (EYD). In the first session, the participants were divided into three groups. The first discussed annotations, landmark decisions, and decision summaries. The second discussed the draft of the regulation of the Minister of Administrative and Bureaucratic Reform on the functional positions in the Registrar’s Office. The third discussed developing the system for general election results disputes (PHPU) settlement.

Muhidin also revealed that the annotations were requested by the House of Representatives (DPR) to help them identify articles and paragraphs of laws that the Court had ruled. The discussion focused on 11 landmark decisions on 8 laws.

He also talked about the development of applications relating to the presidential and legislative election. He proposed that the app relating to the presidential election be developed first because such cases would be ruled first before cases on legislative election.

He also requested that the group discussing the ministerial regulation on functional positions consult with the Human Resources and Organization Bureau, who had made such analyses.
