JAKARTA (MKRI) - Approximately 100 sixth-semester students of Palembang Muhammadiyah University, accompanied by their lecturers, visited the Constitutional Court (MK) on Monday, 31 July, 2023. Court researcher Abdul Basyid Fuadi welcomed them in the main hall.

Fuad delivered a presentation on the state administration system of Indonesia. He explained that the Constitutional Court was established based on the demand of the Reform period in 1998 and the amendment to the Constitution during that time. Although the students had not been born at that time, they must be aware of Indonesia’s great history.

“The Constitutional Court is an institution born from the changes that occurred because of the amendment to the 1945 Constitution. Previously, we did not know the constitutional court,” Fuad explained.

He also emphasized that the changes to Indonesia’s democracy led to the change to the state Constitution and the struggle for human rights. Prior to the amendment to the 1945 Constitution, Indonesia’s administration was vertically hierarchical, as shown by Article 1 paragraph (2) of the 1945 Constitution which reads, “Sovereignty shall be vested in the hands of the people and be executed according to the Constitution.” After the amendment to the 1945 Constitution, Indonesia’s state structure changed to horizontally functional.

“There is no more state institution classifications of highest and high institutions. The institutions supervise and balance each other,” Fuad explained.

He said that the establishment of the Constitutional Court was because there had been no mechanism to review laws. So, the idea of forming the Constitutional Court emerged to improve the mechanism in reviewing laws.
