JAKARTA, MKRI – Judicial review of laws is a necessary form of public supervision of laws to protect human rights. All provisions must be in accordance with the 1945 Constitution so the Constitutional Court (MK) plays a role in upholding the Constitution and meeting the demands of democracy. This statement was made by expert assistant to constitutional justice Muhammad Reza Winata to answer questions of some of 58 students of the Law Faculty of Madura University who visited the Court on Monday, July 31, 2023.
“So, the Constitutional Court was established to uphold the Constitution and protect human rights. And because laws are the result of political compromises of stakeholders so that they are in line with democracy, a court was deemed necessary to review the resulting legal products,” Reza said.
Continuing his presentation, Reza take the students to get to know constitutional rights that are relevant to them, among them are the right to express opinions, the right to equality before the law and in government, the right to health, and the right to education.
“Constitutional rights and the right to education is relevant to students. A petition on the right to education up to higher education was filed and upon review, the Court considered it an open legal policy. This is because there are funds that the government may allocate or may not allocate, but in the future, hopefully when Indonesia has been developed and the people become more prosperous, the right to free education in Indonesia will not only stop at the upper secondary level but also up to university,” Reza explained.
