BANDUNG, MKRI – After presenting his dissertation, the Constitutional Court’s (MK) Chief Registrar Muhidin achieved a doctoral degree in law from Padjajaran University (UNPAD) with excellent grade. He received this degree after successfully defending his dissertation titled “The Dynamics of the Constitutional Court’s Judicial Review and the Constitutional Court’s Constitutional Duty in Ensuring the Upholding of the Citizens’ Constitutional Rights” on Friday morning, July 28, 2023. Chief Justice Anwar Usman and Justices Wahiduddin Adams, Suhartoyo, and Daniel M. P. Sitompul attended dissertation presentation and examination, which took place at the Komar Kantaatmadja building, Law Faculty of Padjadjaran University, Bandung, West Java Province.
During the examination, which lasted almost 2 hours, Muhidin defended his dissertation before supervisors and examiners: UNPAD law professor Huala Adolf, former Judicial Commission chairman for 2010-2015 Eman Suparman, Hasanuddin University law professor and Constitutional Justice M. Guntur Hamzah, UNPAD law professors Indra Perwira and Rukmana Amanwinata, Andalas University law professor and Constitutional Justice Saldi Isra, UNPAD constitutional law senior lecturer Ali Abdurahman, UNPAD administrative law lecturer Zainal Muttaqin, and UNPAD constitutional law professor I Gde Pantja Astawa. Muhidin shared the research background, such as changes in the Constitutional Court Law and necessary alterations to the existing system. Such processes, he argued, can be implemented in a variety of ways, including legislative review and judicial review. “Because the notion that the Constitutional Court is a reformative institution, the Constitutional Court Law has undergone developments, which are subject to petitions by many groups,” he said.
Muhidin also said that the Constitutional Court Law is a piece of legislation that had frequently been petitioned and received a variety of responses from society, particularly regarding the constitutional justices and its supporting units such as the Registrar’s Office and the Ethics Council (MKMK), as well as function-related issues. This affects the Court’s independence so it must exercise caution to ensure its integrity and competency, as it had so far.
Furthermore, Muhidin stated that there had been positive dynamics in the type and material of the Court’s judicial review. Currently, he continued, the Court employs a different examination methodology in formal and material review, favoring formal testing due to time restriction. In addition, when it reviews matters relating to internal interests, it conducts an examination by giving the parties the opportunity to use a more open evidentiary mechanism in presenting experts.
