JAKARTA (MKRI) — A meeting on regulations of the chief justice of the Constitutional Court (PKMK) on the functional positions of constitutional registrars and the settlement of the 2024 presidential and legislative election results disputes (PHPU) was held in the Constitutional Court on Friday, July 8, 2023 in Bandung, West Java Province. Deputy Chief Justice Saldi Isra opened the meeting alongside Secretary-General Heru Setiawan and Chief Registrar Muhidin.
In his remarks, Deputy Chief Justice Saldi Isra said aside from handling cases, the Constitutional Court is also busy with organizational arrangements. Apart from having selected the general-secretary and echelon II officials, the Court was also scheduled to elect members of the Court’s Ethics Council (MKMK).
“The Court’s Ethics Council will be appointed and the vacancies of echelons III and IV will soon be filled. Last but not least, we will also immediately fill in the vacancies of substitute registrars (PP) and expert assistants to constitutional justices (ASLI) because additional ones are still required, including level I substitute registrars that will soon be selected,” Deputy Chief Justice Saldi said.
He said the Court was in a race to carry out substantial tasks and its organizational needs, including preparing technical guidelines on the legislative and presidential election.
“It will be resolved as soon as possible because it will involve the IT team to create the software that will be used in the case handling process. Therefore, we hope that the two key points of the preparation of a PKMK on the constitutional registrar functional positions and a PKMK on the resolution of presidential and legislative election cases,” he said.
Meanwhile, Chief Registrar Muhidin said in his report that some time ago the Registrar’s Office and the Secretariat-General of the Constitutional Court had compiled the Constitutional Court regulations (PMK) on the settlement of the 2024 general and regional election results disputes, which the Chief Justice had ratified.
“Then, to help understanding the PMKs, the PMKs should be disseminated as the technical guidelines for the constitutional justices, Court staff members, justice seekers, and citizens,” said Muhidin
Muhidin said that the drafting of PKMK would hopefully help the resolution process election results disputes, make it speedy, and produce clear technical guidelines for the Court staff who will join the general election results dispute (PHPU) taskforce.
He also explained that the Court had ruled Article 7A paragraph (1) of Law No.7 of 2020 on the Third Amendment to Law No. 24 of 2003 on the Constitutional Court conditionally unconstitutional in Decision No. 121/PUU-XX/2022. The decision requires a follow-up in the PKMK on the functional positions of the Court’s registrars.
The meeting lasted for three days from Friday to Sunday, July 28-30, 2023 in Bandung, West Java Province. Sixty-one participants participated in the drafting of the PKMK on the functional positions of the Court’s registrars as well as the settlement of disputes over the results of the election of the president and vice president and legislative members in 2024.
