JEMBER (MKRI) — In 2024, Indonesia will hold simultaneous election of president, vice president, legislative members, and regional heads. Eighteen national parties and six Aceh parties will participate. The Constitutional Court (MK) as a constitutional judicial institution has made tools to help justice seekers in resolving cases relating to the election.
The statement was made by Constitutional Justice Wahiduddin Adams at his opening presentation at a national seminar with the Constitutional Court in order to build an academic culture at the Sharia Faculty of UIN Kiai Haji Siddiq (FS UIN KHAS) Jember on Friday, July 14, 2023. The theme was “The Constitutional Court’s Role in Handling the 2024 General Election Results Disputes.” FS UIN KHAS also invited lecturer Basuki Kurniawan as a speaker.
Justice Wahiduddin further said that as control in ensuring the implementation of general election properly and in accordance with electoral principles, the Constitutional Court resolve election violations or disputes in terms of the final results of the vote acquisition of the parties. At the beginning, when filing a petition to the Court, all parties must prepare all the necessary documents properly, for example, proof of appointment as a candidate for legislative member or regional head and their campaign team.
“The Court has 400-600 people who will assist the justices in resolving all cases [and examining] the evidence submitted by the parties. This is how the Court improves the speed of resolving cases with a limited time, 30 days for general election and 45 days for regional election. So, the parties are ready to win but also must be ready to lose and submit evidence that is truly concrete in support of fighting for the justice,” he explained. The seminar, taking place at the library hall of UIN KHAS Jember, was also attended by rector Babun Suharto and interim dean Muhammad Faisol.
In his presentation, Justice Wahiduddin also explained and emphasized the things that must be properly prepared by the parties who want to submit a petition to the Constitutional Court. Meanwhile, the Court prepares rules to facilitate them in litigating and obtaining justice. One of its efforts is to hold hearings without charge and they are open to the public. “This is a cursory overview of what the Constitutional Court has done to prepare for the handling of general and regional election cases. It has also learned from the settlement of cases in previous elections,” he explained.
Specifically, Justice Wahiduddin explained that the Constitutional Court had also hold workshops for national political parties and Aceh local ones participating in the upcoming election. In addition, workshops had also been held for election organizers, such as the KPU (General Elections Commission), Bawaslu (Elections Supervisory Body), and advocates who would accompany justice seekers at the Constitutional Court. He also explained about the parties that can submit PHPU petitions in the upcoming 2024 and the mechanism for resolving cases. At the end of his presentation, he hoped that the upcoming simultaneous general and regional election could be carried out with good democratic values so that it will result in leaders who follow the ideals of the Indonesian people.
