BUDAPEST (MKRI) — Constitutional Justice Enny Nurbaningsih fulfilled an invitation from the Constitutional Court of Hungary in Budapest on Tuesday, June 20, 2023). Along with the delegation of the Constitutional Court of the Republic of Indonesia (MKRI), Justice Enny met with the President of the Constitutional Court of Hungary, Tamás Sulyok, and Chief of Cabinet Attila Szabó. At the meeting, held in the meeting room of the Constitutional Court, the delegations discussed several important issues on the follow-up to the World Conference on Constitutional Justice (WCCJ) 2022 agreement on constitutional supremacy index and the importance of the Constitutional Court’s institutional development for effective implementation of its authority.

At the meeting, Justice Enny explained that one of the challenges for the Constitutional Court is to maintain the consistency of the substance of interrelated decisions. To prevent conflicts between the Court’s decisions, it is necessary to strengthen the supporting units responsible for reviewing cases or providing input to the Court. President Sulyok also agreed on this matter and revealed that his Court had formed a legal advisory team whose task is to ensure that any draft decision does not conflict with previous decisions. This team provides substantial support to the Court. In addition, the Constitutional Court of Hungary also utilizes digital technology to share documents that can be edited together within the internal system (intraweb).

Justice Enny also said that the MKRI had learned a lot from other courts, including the Constitutional Court of Hungary, because the latter handles various constitutional issues in various forms of petitions. Szabó also revealed that the Court receives around 6,000 petitions a year, but only one-third of them have sufficient substance to be examined in depth. The MKRI and the Constitutional Court of Hungary agreed that if the MKRI authority is expanded to include constitutional complaint cases, an effective mechanism will be needed to sort out the petitions that come in so that there will be no backlog of cases. The meeting and discussion between the two courts ended with an agreement that they will always maintain communication and share information, especially regarding the institutional development.
