JAKARTA (MKRI) — In order to discuss the drafting of an academic paper on “The Supreme Court’s Regulations on the Selection and Nomination of Constitutional Justices by the Supreme Court,” the Supreme Court Judicial Training Center had an audience with the Constitutional Court (MK) on Tuesday, June 20, 2023. The center’s judicial judge M. Ikbar Andi Endang, judicial high judge Rita Herlina, evaluation analyst Bestian Panjaitan, and staff Imam Buhori as well as lecturer of the Christian University of Indonesia Morus Maxine Sianipar were welcome by head of the Center for Research, Case Review, and Library Management Kurniasih Panti Rahayu, expert assistants to constitutional justices Pan Mohamad Faiz K. and colleagues at one of the Court’s meeting rooms.
Ikbar said the center wished to have a discussion on the selection and nomination procedure of constitutional justice candidates by the Supreme Court. As mandated by the 1945 Constitution and the Constitutional Court Law, the Supreme Court, the House of Representatives (DPR), and the Government/President each nominate three constitutional justices. Based on the results of the hearing with the leadership of the Supreme Court, Ikbar revealed, there was a shift in the term of constitutional justices. Therefore, it requires further regulation.
"So far, [the selection and nomination] has been the chief supreme justice’s prerogative. On December 8, 2023, Constitutional Justice Manahan M.P. Sitompul will retire, so the Supreme Court conducted open recruitment on May 25-28, 2023. The Judicial Training Center must carry out academic studies. We would like the Constitutional Court to inform the ongoing open selection, whether the House and the President/Government apply open or closed recruitment. We found a new mixed recruitment that allows public hearings via application. So, the ideal design of this mechanism is how in the future the leadership can also participate in the nomination of constitutional justices,” he revealed.
On behalf of the Court, Pan Mohamad Faiz expressed appreciation for the Judicial Training Center’s wish to collaborate on the drafting of the academic paper on the selection and nomination of constitutional justice candidates by the Supreme Court. “We really appreciate your wish to collaborate on drafting of the academic paper on the selection and nomination of constitutional justice candidates by the Supreme Court,” he said.
