JAKARTA (MKRI) — Fifty students of the senior high boarding school SMA Al-Furqon of Tangerang visited the Constitutional Court (MK) on Thursday, June 15, 2023. They were welcome by the expert assistant to constitutional justice Rizkisyabana Yulistyaputri.
Kiki explained that after the amendment to the 1945 Constitution and there is no longer a supreme state institution, everything is regulated in such a way in the 1945 Constitution. The Constitutional Court is the result of the amendment to the 1945 Constitution. It has the authority to review laws against the 1945 Constitution, where previously there was no judicial institution to have the authority to do so.
Another authority of the Constitutional Court is to decide disputes between state institutions whose authority is granted by the Constitution. Previously, any authority disputes between state institutions would be resolved by the president through a political decision.
The Court also has the authority to decide disputes over general election results. In addition, it is obligated to decide the House of Representatives’ (DPR) opinion whether the president and/or vice president has violated the Constitution.
Based on its authority, the Constitutional Court has several roles and functions: the guardian of the Constitution, the final interpreter of the Constitution, the guardian of democracy, the protector of citizens’ constitutional rights, the protector of human rights, and the guardian of state ideology.
Kiki also explained that human rights are generally recognized basic rights that apply in various countries while constitutional rights are rights given to every citizen in accordance with what has been regulated by the Constitution. Every citizen can file a judicial review petition to the Constitutional Court if they feel that their constitutional rights have been violated due to the enactment of any law.
She further explained that the Court is a modern and trusted judicial institution. This is marked by the Court’s use of information and communication technology long before the pandemic.
Kiki also revealed that the Court’s employees are not all law graduates, but come from various educational backgrounds depending on their respective work units, because the Court is also supported by general administration, such as librarians, IT officers, and others. She also explained the organizational structure of the Registrar’s Office and the Secretariat-General of the Constitutional Court as well as their duties and functions.
Eleventh grade students of the science and social studies majors participated in this company visit annually. The aim is to give students an overview of work environments and state institutions.
