JAKARTA (MKRI) — The Constitutional Court (MK) Chief Justice Anwar Usman read a decree approving the withdrawal of the material judicial review petition of Law No. 1 of 1946 on the Criminal Code (KUHP) on Thursday, June 15, 2023 in the plenary courtroom. The petition was filed by M. Jamil.
“Menetapkan, mengabulkan penarikan kembali permohonan Pemohon,” kata Ketua MK Anwar Usman dengan didampingi tujuh hakim konstitusi saat membacakan Ketetapan Nomor 48/PUU-XXI/2023.
“[The Court] determines, grants the withdrawal of the Petitioner’s petition,” Chief Justice Anwar Usman said alongside seven other constitutional justices while reading the Decree No. 48/PUU-XXI/2023.
Anwar menyebutkan, MK telah menerima permohonan bertanggal 15 April 2023, yang diajukan oleh M. Jamil, yang berdasarkan Surat Kuasa Khusus bertanggal 15 April 2023 memberi kuasa kepada Risky Kurniawan dan Albert Ola Masan Setiawan Muda yang diterima Kepaniteraan Mahkamah Konstitusi pada tanggal 15 April 2023.
He mentioned that the Court had received the petition dated April 15, 2023, filed by M. Jamil based on the special power of attorney dated April 15 to Risky Kurniawan and Albert Ola Masan Setiawan Muda, which the Court’s Registrar’s Office on the same day.
Setelah itu, Mahkamah melaksanakan sidang panel pemeriksaan pendahuluan terhadap permohonan tersebut pada 17 Mei 2023. Dalam sidang ini sesuai dengan Pasal 39 UU MK serta Pasal 41 ayat (3) Peraturan Mahkamah Konstitusi Nomor 2 Tahun 2021 tentang Tata Beracara dalam Perkara Pengujian UndangUndang, Panel Hakim telah memberi nasihat kepada Pemohon untuk memperbaiki permohonannya, termasuk memperbaiki Surat Kuasa dalam permohonan.
The Court then held a preliminary hearing on Wednesday, May 17. At the hearing, the justice panel gave the Petitioner advice for the revisions to the petition based on Article 39 of the Constitutional Court Law and Article 41 paragraph (3) of the Constitutional Court Regulation (PMK) No. 2 of 2021 on the Procedural Law for Judicial Review Cases. Their recommendations include revising the power of attorney.
Namun, sebelum pelaksanaan sidang panel dengan acara pemeriksaan perbaikan permohonan Pemohon, Mahkamah menerima surat dari Pemohon, bertanggal 21 Mei 2023, perihal Penarikan Kembali Permohonan Pengujian UndangUndang Nomor 1 Tahun 1946 tentang Peraturan Hukum Pidana terhadap Undang-Undang Dasar Negara Republik Indonesia Tahun 1945.
Berikutnya, pada 30 Mei 2023, Mahkamah menyelenggarakan sidang panel dengan acara pemeriksaan perbaikan permohonan Pemohon guna meminta konfirmasi kepada Pemohon perihal pencabutan dimaksud. Dalam persidangan ini, majelis hakim panel telah menerima konfirmasi dari Pemohon yang membenarkan penarikan permohonan tersebut.
However, the Court received a petition withdrawal letter dated May 21. Then, on May 30, the Court held a petition revision hearing to ask for confirmation on the request, which the Petitioner answered in the affirmative.

The Petitioner—head of the RW (rukun warga or community unit) 010 Sungai Pelungut Village, Sagulung Subdistrict, Riau Islands Province—felt threatened by a person with mental disorders (ODGJ) who loitered around his residence. Due to the unclear and multi-interpretive implementation of the a quo article, the Petitioner, who does not have any family member with mental disorders, feared criminalization. He believed the norm in question could not provide him with protection, so the persons in charge of taking care of the person with mental disorder is their family member or official authorized to do so.
In the petitum, the Petitioner requested that the Court declare Article 491 point 1 of the KUHP unconstitutional if the phrase “who is” not be added to the article so that it would read, “any person, who is charged with the surveillance of a lunatic dangerous for himself and for others, allows said lunatic to wander unguarded.”
