JAKARTA (MKRI) — Expert assistant to constitutional justice Mohammad Mahrus Ali welcomed 188 students of sharia economic study program of the State Islamic University (UIN) of Salatiga on Tuesday, June 13, 2023 at the fourth floor of the Constitutional Court’s (MK) main building.

Ali delivered a presentation on the Court’s authority (4) and obligation (1): to adjudicate laws against the 1945 Constitution at the first and last instance with decisions that are final, to settle authority disputes between state institutions whose authority is granted by the 1945 Constitution, to decide the dissolution of political parties, and to settle disputes over general election results. It is also obligated to decide the House’s opinion on an alleged violation of law committed by the president and/or vice president, pursuant to Article 24C paragraphs (1) and (2) of the 1945 Constitution.

The violations are stated in Article 7A of the 1945 Constitution: treason, corruption, bribery, other criminal acts, or despicable acts, and/or no longer qualifying as president and/or vice president as referred to in the 1945 Constitution.

Ali further explained the composition of constitutional justices selected by three selection committee members: House of Representatives (DPR), Supreme Court, and president. “Constitutional justices are selected by three state institutions: three by the House, three by the Supreme Court, and three by the president. After undergoing a test by the selection committee, the selected names will be submitted to the president and inaugurated," he explained.

Then Ali mentioned some of the Court’s judicial review decisions, such as its decisions on the material and formal judicial review of the Job Creation Law. The Court has granted petition on the Job Creation Law process. “Through this decision, the Court carries out checks and balances function because not all laws are in accordance with what the people need,” Ali added.
