JAKARTA, (MKRI) — Students of SMP 176 Jakarta visited the Constitutional Court (MK) on Wednesday, May 17, 2023 and were welcomed by assistant to constitutional justice Intan Permata Putri at the Court’s main hall.
In her presentation on “The Constitutional Court and State Institutions,” Intan said that the executors of the judicial power are stipulated in Article 24 of the 1945 Constitution. Prior to the amendment to the Constitution, the judicial power was made by a Supreme Court and by other judicial bodies pursuant to legislation. The composition and powers of these judicial bodies were regulated by law.
Then, after the amendment, judicial power constitutes an independent power to hold a judicature for law reinforcement and justice. Judicial power is made by a Supreme Court and judicial bodies thereunder within a general judicature, religious court, military court, state administration court, and by a Constitutional Court.
Intan further explained that pursuant to Article 24C paragraphs (1) and (2) of the 1945 Constitution, the Constitutional Court has the authority to adjudicate laws against the 1945 Constitution at the first and last instance with decisions that are final, to settle authority disputes between state institutions whose authority is granted by the 1945 Constitution, to decide the dissolution of political parties, and to settle disputes over general election results. It is also obligated to decide the House’s opinion on an alleged violation of law committed by the president and/or vice president, pursuant the Constitution.
In addition, based on the Constitutional Court Decision No. 85/PUU-XX/2022, it also has the authority to adjudicate disputes over the results of regional head election. In its legal considerations, the Court stressed that the regional head election is part of the general election.
After her presentation, Intan started a Q&A session on the Court’s authority. Then she took the students to visit the Constitution History Center (Puskon) at the fifth and sixth floors of the Court’s main building.
