JAKARTA (MKRI) — On Thursday morning, May 11, 2023, 190 students of public senior high school SMAN 5 Tangerang visited the Constitutional Court (MK). They were welcomed by expert assistant to constitutional justice Rizkisyabana Yulistyaputri at the Court’s main hall. She then delivered a presentation on “The Constitutional Court Safeguarding the Citizens’ Constitutional Rights.”
Rizky started by explaining the background of the establishment of the Constitutional Court as well its authority and obligation. ‘The Constitutional Court has the authority to adjudicate laws against the 1945 Constitution, to settle authority disputes between state institutions whose authority is granted by the 1945 Constitution, to decide the dissolution of political parties, and to settle disputes over general election results,” she said. It also has an obligation to decide the House’s opinion on an alleged violation of law committed by the president and/or vice president based on the 1945 Constitution.
She also talked about the nine constitutional justices. “The Constitutional Court justices are nominated by three institutions: the House of Representatives (DPR), the Supreme Court, and the president. However, [candidates] must undergo tests,” she added.
She also explained who can file a petition to the Court. The Court’s regulation (PMK) dictates that Indonesian individuals or groups of citizens, customary law communities who live according to societal developments and the principles of the Unitary State of the Republic of Indonesia, private and public legal entities, as well as state institutions who believe their constitutional rights and/or authorities are violated due to the enactment of the law petitioned can do so.
Risky closed the session by explaining briefly about the Court’s Constitution History Center on the fifth and sixth floors of the Court’s main building. She also revealed that the Court’s library is located on the third floor of the Court’s second building.
