Chief Registrar Talks Court’s Preparation Ahead of 2024 Simultaneous Election

BANDUNG (MKRI) — A petition challenging the 2024 General Election Results Dispute Resolution (PHPU) has a deadline of 3x24 hours since the KPU (General Elections Commission) announces the vote results. This applies for the election of president-vice president as well as members of the DPR (House of Representatives) and DPRD (Regional Legislative Council), said the Court’s chief registrar Muhidin at the work meeting on criminal investigation for 2023 in Bandung, West Java Province on Tuesday afternoon, March 14, 2023.

In his presentation on “The Preparation for Resolving 2024 Election Results Disputes in the Constitutional Court,” he also said that the Court had issued three Constitutional Court regulations (PMK) in 2023 as legal basis for 2024 PHPU: No. 2 on the procedure for PHPU on DPR and DPRD, No. 3 on the procedure for PHPU on DPD (Regional Representatives Council), and No. 4 on the procedure for PHPU on presidential election.

He revealed that in 2019, the Court received 330 PHPU cases on DPR/DPRD, 10 cases on DPD, and 1 case on the presidential election. He said most cases concerned vote reduction, vote inflation, ethics violations by organizers, and other election violations.

Muhidin also revealed that the petition for the upcoming presidential election can be filed since February 15 to March 23, 2024 and will be listed in the electronic constitutional case registration book (e-BRPK) and the copy sent to the KPU (respondent) and Bawaslu (Elections Supervisory Body) on April 17. Parties are to request to be relevant parties on April 17-18. The notification of the first hearing schedule will be sent out to the litigating parties and informants on Paril 18-19. The preliminary hearing will take place on April 22, while the revised responses are to be submitted on April 19-23. The evidentiary hearings will take place on April 24-29, followed by justice deliberation meetings on April 30-May 6. Finally, the ruling hearings will take place on May 7.

“The Court has 14 workdays to resolve presidential election results disputes and 30 workdays for the legislative election results disputes,” Muhidin stressed.
