BOGOR (MKRI) — The workshop on the 2024 General Election Results Dispute Resolution (PHPU) for the National Democrat (Nasdem) Party continued on the third day on Wednesday, March 8, 2023 for practice drafting a PHPU petition and relevant party’s statement. Substitute registrar Achmad Edi Subiyanto spoke at the event at the Pancasila and Constitution Education Center in Bogor, West Java Province.
In his presentation, he explained that the first object in a PHPU case of DPR (House of Representatives) and DPRD (Regional Legislative Council) election is the respondent’s (KPU, General Elections Commission) certification of the national valid votes. Meanwhile, the litigants are the petitioner, the respondent, and the relevant party.
The petitioner could be national and local political parties participating in election, DPR and DPRD member candidates of a certain party. “The respondent is the election organizer. The relevant party is any party that has a stake on the petition, such as national and local political parties participating in election and DPR and DPRD member candidates of a certain party,” Edi added.
He also explained that the Court is prepared to receive petitions within the deadline under the Constitution, i.e. 3x24 hours. “The petition should be filed within 3x24 hours since the KPU announced the results. The Constitutional Court will work 24 hours to receive the petition. If the petition is complete, it will be registered by the Registrar’s Office,” he said.
He also explained the reasons why the Court cannot accept a petition: if the petition is obscure, it does not explain the respondent’s vote counting errors and the petitioner’s version of vote results, if the petition is contradictory and does not provide any alternative.
“If the petitum does not request that the KPU’s decision on the recapitulation results be revoked or if the petitum does not request the certification of the petitioner’s vote results, and typos (in the details of loss of votes, the name of the village, and the name of the subdistrict),” he added.
In the next session, the participants were divided into several classrooms to practice drafting a PHPU petition and relevant party’s statement. Each classroom was guided by facilitators, i.e. a substitute registrar and an expert assistant to constitutional justice.
The workshop will be taking place on Monday-Thursday, March 6-9, 2023 with 128 attendees from the Nasdem Party. The participants will follow presentations on the Constitutional Court and the dynamics of PHPU; the procedural law for PHPU; the mechanism, stages, and schedule; drafting a PHPU petition and relevant party’s statement; and the electronic case management information system and have their petition and relevant party statement evaluated. The speakers were constitutional justices, deputy registrar, expert assistant to constitutional justice, and more.
