BOGOR (MKRI) — The workshop on the 2024 General Election Results Dispute Resolution (PHPU) for the National Democrat (Nasdem) Party continued on the second day on Tuesday, March 7, 2023. The event, which administrators and members of the party attended, took place at Grha 3 of the Pancasila and Constitution Education Center in Bogor, West Java Province.

Substitute registrar Mardian Wibowo explained the history of the Indonesian Constitution, the amendment to the 1945 Constitution, the citizens’ constitutional rights, and the Constitutional Court’s functions and authority. “The idea of establishing a constitutional court in Indonesia emerged post-Reform [of 1998], reflecting on the state practices in the Old Order and the New Order, where those in power had interpreted the Constitution to suit their interest,” he said.

He then explained the Court’s authority: reviewing laws against the Constitution, deciding disputes over the authority of state institutions whose authority is granted by the Constitution, deciding on the dissolution of political parties, and deciding disputes over election results. The Court’s obligation, following Article 24C paragraph (2) of the 1945 Constitution, is to decide on the opinion of the House of Representatives (DPR) regarding allegations of violations by the president and/or vice president according to the Constitution.

He also explained the deadline and stages for filing PHPU petition for the election of DPR (House of Representatives) and DPRD (Regional Legislative Council) and the legal basis. “The deadline is 3x24 hours since the central KPU announces the vote acquisition,” he emphasized.

Stages of PHPU Filing

Next, deputy registrar Triyono Edy Budhiarto gave a presentation on “The Mechanism, Stages, and Schedule of the 2024 PHPU.” He urged caution with regard to PHPU petition, either as a petitioner or a relevant party. He reminded the participants that the deadline for filing the petition was important because if filed past the deadline, it would be dismissed.

He then explained that after the petition’s documents are reviewed and declared complete, the petition is recorded in the electronic constitutional case registration book (e-BPRK). The petition is then sent to the Respondent, in this case the KPU (General Elections Commission), and to the Bawaslu (Elections Supervisory Body). The request to be a relevant party is then accepted and the hearing schedule announced to litigants. Next, a preliminary hearing takes place, followed by evidentiary hearings, a justice deliberation meeting, and a ruling hearing where a decree/decision is handed out and the copy of the decree/decision is distributed.

Edy requested that the participants understand the Court’s procedural law. The Court, he said, hopes that the filing of PHPU petitions in the 2024 Election will be optimal and that all documents and evidence are complete.

Case Management Information System

In the next session, Muhammad Ridho Ihsan and Jeklin Indriani Purba from the IT Department delivered a presentation on the electronic case management information system. They explained the technical side and simulated filing a petition online, both as a petitioner and a relevant party. They also showed the participants how to track the petition through the Court’s application.

Justice seekers, they said, can file a petition online through the electronic petition information system (Simpel) by registering to get a login account. After filing the petition, they will receive a receipt. When the petition has been registered, they will receive e-mail and text notification from the Registrar’s Ofiice.

The IT team also explained that the use of information and communications technology (ICT) is the Court’s commitment as a modern and trusted judicial institution to providing access for all parties in filing a petition. The Court promotes ICT-based work system and mindset that is based on integrity, cleanliness, and trustworthiness.

The workshop will be taking place on Monday-Thursday, March 6-9, 2023 with 128 attendees from the Nasdem Party. The participants will follow presentations on the Constitutional Court and the dynamics of PHPU; the procedural law for PHPU; the mechanism, stages, and schedule; drafting a PHPU petition and relevant party’s statement; and the electronic case management information system and have their petition and relevant party statement evaluated. The speakers were constitutional justices, deputy registrar, expert assistant to constitutional justice, and more.
