BOGOR (MKRI) — The workshop on the procedural law for the 2024 General Election Results Dispute Resolution (PHPU) for the Golongan Karya (Golkar) Party continued into the third day. Substitute registrar Syukri Asy’ari delivered a presentation on “Drafting Petitioner’s Petition and Relevant Party’s Statement for the 2024 PHPU” on Wednesday, March 1, 2023 at Grha Konstitusi 3 of the Pancasila and Constitution Education Center (Pusdik) in Bogor, West Java Province.
Starting his presentation in the fifth session, he introduced the litigants in PHPU. First, there is the petitioner, which could be political parties participating in election, DPR (House of Representatives) or DPRD (Regional Legislative Council) member candidates of a certain party who have obtained the approval of the party’s chairman and secretary-general, or DPRA (Aceh Legislative Council) and DPRK (Aceh Regency Legislative Council) members for Aceh parties. Second, there is the respondent—the election organizer. Third, there is relevant parties, any party that has a stake on the petition, such as national and local political parties participating in election and DPR and DPRD member candidates of a certain party who have obtained the approval of the party’s chairman and secretary-general.
“So, you should follow the developments in the Court’s website, whether there are cases related to your party, which could impact the filing of the petition for the litigating parties, such as relevant parties. Statement must be submitted to the Court. It the statement is submitted past deadline, it cannot be considered. Consider this,” said Syukri alongside moderator Bambang Sukmadi, Head of Pusdik’s Infrastructure and Facilities Division.
Syukri also talked about Golkar’s petitions in 2019 PHPU—19 petitions from 33 provinces or 55 electoral districts: 9 out of 80 electoral districts for DPR, 10 out of 272 districts for provincial DPRD, and 36 out of 2,206 districts for regency/city DPRD. The Court granted petitions on 3 districts, where it approved the correct vote results for DPRD of Bintan 3 and Banda Aceh City 3 and ordered a recount of votes for DPRD of Surabaya City 4. Meanwhile, it rejected petitions on 11 districts, dismissed petitions on 33. Petitions on five districts were withdrawn, while those on four districts fell through.
“This workshop is important so that in drafting the petition, it would not be declared obscure by the Court, for example for not elaborating the counting errors which the respondent certified and not providing the correct vote results, or for only providing a comparison table of the vote results without any explanation. So, provide legal facts that show the margins,” he said.

In the sixth session, the participants were divided into several classrooms to practice drafting a PHPU petition and relevant party’s statement. Each classroom was guided by a facilitator, i.e. Dian Chusnul Chatimah, Suryo Gilang Romadlon, Oly Viana Agustine, and Mohammad Mahrus Ali.
